HomeMy WebLinkAbout20072 RES - 11/17/1987A RESOLUTION AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE ACQUISITION OF PARCEL 6 IN CONNECTION WITH THE MARY CARROLL CHANNEL WIDENING; AND APPROPRIATING $9,058. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute the documents necessary for the acquisition of Parcel 6 in connection with the Mary Carroll Channel Widening, Project 511-86-5.1, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That there is hereby appropriated $9,058 out of the 511 Storm Sewer Bond Fund. W. HELDENFELS, JR., the President thereof, who is authorized so to act, of the County of Nueces, State of Texas, for and in consideration of the sum of Nine Thousand Fifty-eight Dollars and no cents [$9,058.00] to me in hand paid by the City of Corpus Christi, Nueces County, Texas, the receipt of which is hereby acknowledged, have GRANTED and CONVEYED, and by these presents do GRANT and CONVEY unto the City of Corpus Christi, Texas, a municipal corporation duly incorporated under and by virtue of the laws of the State of Texas, its successors and legal representatives the free and uninterrupted use, liberty, privilege, and easement of going in, on, over, under and along a certain tract of land situated in Nueces County, Texas and being described as follows: See Page 2 "Drainage Easement" MARY CARROLL CHANNEL WIDENING Parcel 6 [Heldenfels] Page 1 of 6 Being a 10 foot wide strip of land out of Tracts B and C, Lot 3, Lokey Subdivision, shown by plat in Volume 7, Page 16, Map Records, Nueces County, Texas and being further described as follows: Beginning at a point being North 29 degrees East, 37.50 feet from the original southmost corner of said Tract C; Thence North 61 degrees West at 165.00 feet pass the common lot line of said Tracts B and C, in all a distance of 330.00 feet to a point on the northwest lot line of said Tract B; Thence North 29 degrees East along said lot line, 10.00 feet to a point for the northmost corner of this tract; Thence South 61 degrees East at 165.00 feet pass the common lot line of said Tracts B and C, in all a distance of 330.00 feet to a point on the southeast lot line of said Tract C; Thence South 29 degrees West along said lot line, 10.00 feet to the point of beginning and containing 0.076 acres, more or less. Together with the free ingress, egress and regress to and for the City of Corpus Christi, Texas for the purpose of constructing a public drainage facility and for the purposes of maintaining, servicing, repairing and inspecting said public drainage facility under, on and along said tract. TO HAVE AND TO HOLD, all and singular, the rights and privileges aforesaid to the City of Corpus Christi, Texas, its successors and legal representatives, for the proper use as a DRAINAGE EASEMENT and drainage right-of-way, for so long as used for such purpose, and if the use for said easement and way of said uses be ever abandoned, then in that event, the aforesaid rights and privileges shall cease. The City, at City's expense shall remove the fence presently existing in the R.O.W. and shall relocate the fence and rebuild the fence in as good as or better condition as the fence removed.
