AUTHORIZING THE EXECUTION OF THE DOCUMENTS NECESSARY FOR THE
ACQUISITION OF PARCEL 11 IN CONNECTION WITH THE MARY CARROLL
CHANNEL WIDENING; AND APPROPRIATING $4,018.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute the
documents necessary for the acquisition of Parcel 11 in connection with the Mary
Carroll Channel Widening, Project 511-86-5.1, a substantial copy of which is
attached hereto and made a part hereof, marked Exhibit A.
SECTION 2. That there is hereby appropriated $4,018 out of the 511
Storm Sewer Bond Fund.

That PATRICIA RAY PETERSON NUSS, Trustee for MELYNDA SUSAN NUSS,
ERIC GRAHAM NUSS and DAVID CHRISTIAN NUSS, under a Trust Indenture
and Declaration dated December 26, 1973 as to an undivided 3/7ths
interest, CHRISTY ANN PETERSON BROWN, Trustee for ALYSSA ANN BROWN
and REAGAN TRAVIS BROWN, under a Trust Indenture and Declaration dated
December 26, 1973 as to an undivided 2/7ths interest and JAMES DOUGLAS
PETERSON, Trustee for KATHERINE AVILLA PETERSON and SCOTT DOUGLAS
PETERSON, under a Trust Indenture and Declaration dated December 26,
1973 as to an undivided 2/7ths interest, for and in consideration of
the sum of Four Thousand'Eighteen Dollars and no cents [$4,018.00]
to us in hand paid by the City of Corpus Christi, Nueces County, Texas,
the receipt of which is hereby acknowledged, have granted and conveyed,
and by these presents do grant and convey unto the City of Corpus
Christi, Texas, a municipal corporation duly incorporated under and
by virtue of the laws of the State of Texas, its successors and legal
representatives, the free and uninterrupted use, liberty, privilege,
and easement of going in, on, over, under and along, for the purposes
stated herein, a certain tract of land situated in Nueces County, Texas
and being described as follows:

BEING a triangularly shaped tract of land out of Lot 7, Section
19, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat
in Volume A, Pages 41-43, Map Records, Nueces County, Texas, and
being further described as follows:
BEGINNING at a point being the westernmost corner of Said
Lot 7;
THENCE North 29° East along the northwest lot line of said
Lot 7 60.00 feet to a point being the southmost corner of Lot
33, Block 1, Windsong Subdivision Unit 2, shown by plat in Volume
51, Pages 138-138, Map Records, Nueces County, Texas;
THENCE South 16° East 84.85 feet to a point on the southwest
lot line of said Lot 7;
THENCE North 61° West along said southwest lot line 60.00
feet to the point of beginning and containing 0.041 acres, more
or less.
As shown on the map marked Exhibit A which is attached hereto
and made a part hereof for all purposes;
Together with the free ingress, egress and regress thereon, to
and for the City of Corpus Christi, for the purpose of constructing
streets, sidewalks, curbs, gutters and appurtenances upon said tract
and way, for the public use by foot, with automobiles, carts, carriages
and all other vehicles and all other means of transportation necessary
or convenient at all times and in all seasons in, along and upon said

tract and way, as well as for laying, repairing, servicing and
maintaining of public utility lines and storm sewers in, on, under
and along said tract or way.
TO RAVE AND TO HOLD, all and singular, the rights and privileges
aforesaid to the City of Corpus Christi, Texas, its successors and
legal representatives, for the proper use as storm drainage utility
easements for so long as used for such purposes or any of them, and
if the use for said tract and way for all of said used be ever abandoned,
then in that event, the aforesaid rights and privileges shall cease,
and all rights herein granted shall revert to the Grantors herein,
their heirs or assigns.
