AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE TEXAS
WATER COMMISSION TO AMEND THE CHOKE CANYON WATER RIGHTS.
WHEREAS, by final decree of the 73rd District Court of Bexar County,
Texas, in Cause No. 82 -CI -01498, entitled IN RE: THE ADJUDICATION OF WATER
RIGHTS IN THE FRIO-ATASCOSA WATERSHED OF THE NUECES RIVER BASIN, rights to
impound water in and utilize water from Choke Canyon Reservoir were recognized
in the City of Corpus Christi ("Corpus Christi") and the Nueces River Authority,
which rights are evidenced by Certificate of Adjudication No. 21-3214; and
WHEREAS, Corpus Christi has entered into a water sales agreement with
the City of Three Rivers ("Three Rivers"), executed December 3, 1984, in which
Corpus Christi has agreed to supply water to Three Rivers from Choke Canyon
Reservoir as well as from the Campbellton Wells on the Atascosa River; and
WHEREAS, the water sales agreement requires Corpus Christi to amend
Certificate of Adjudication No. 21-3214 so as to provide for a point of
diversion and rate of diversion for Three Rivers; and
WHEREAS, Corpus Christi desires to additionally amend Certificate of
Adjudication No. 21-3214 as follows:
(a) to convert 200 acre-feet of its annual industrial appropriation
of water to irrigation purposes for the benefit of the Choke
Canyon State Park;
(b) to authorize a cofferdam or dike within an arm of the reservoir
for enhancement of the authorized recreational use of the waters
impounded in the reservoir; and
(c) to authorize the diversion of water to be used for domestic and
livestock purposes at any point on the perimeter of the
reservoir; and
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, THAT:
1. The submission of an application to the Texas Water Commission is
authorized to amend Certificate of Adjudication No. 21-3214 in
the manner set forth in the preamble of this Resolution.
2. The City Manager or his designated representative is authorized
to execute the application on behalf of the City of Corpus
Christi, Texas, act as the City's official representative with
respect to the application and in appearances before the Texas
Water Commission, and do any and all things necessary and
appropriate to prosecute or assist in prosecuting the application
to a conclusion.
