HomeMy WebLinkAbout20129 ORD - 12/22/1987AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE BY APPROXIMATELY 175 -FOOT LONG PORTION OF 80 -FOOT WIDE SAN ANTONIO STREET RIGHT-OF-WAY ADJACENT TO LOTS 48 THROUGH 54, BLOCK 215A, PORT ARANSAS CLIFFS SUBDIVISION; PROVIDING FOR REPLATTING WITHIN 180 DAYS OF THE DATE OF THIS ORDINANCE; AND DECLARING AN EMERGENCY WHEREAS, notice of the time and place for holding a hearing concerning the closing of a 10 -foot wide by approximately 175 -foot long portion of 80 -foot wide San Antonio Street right-of-way, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held at a meeting of the City Council of the City of Corpus Christi on December 1, 1987, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portion of right-of-way, proposed to be closed, is not needed now, nor will they be within the foreseeable future needed as public rights-of-way, and that the same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned a 10 -foot wide by approximately 175 -foot long portion of 80 -foot wide San Antonio Street right-of-way adjacent to Lots 48 through 54, Block 215A, Port Aransas Cliffs Subdivision, shown by plat in Volume A, Page 27, Map Records, Nueces County, Texas, and further described by attached metes and bounds, marked Exhibit "A", providing for replatting within 180 days of the date of this ordinance. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall t effect upon first reading as an emergency measure this the X4, day of beK , 19g - ATTEST: City Secretary YOR APPROVED: /7z4 DAY OF ,D.P.Ce-- e,- , 19 HAL GEORGE, CITY ATTORNEY By ssi tant ity ttorne 205rp0O9.ord THE CITY OF CORPUS CHRISTI, TEXAS zoizsMlCROfILM ED METES AND BOUNDS DESCRIPTION SAN ANTONIO STREET CLOSURE Being an irregularly shaped tract of land out of the existing 80 -foot wide San Antonio Street right-of-way adjacent to Lots 48 through 54, Block 215A, Port Aransas Cliffs Subdivision, shown by plat in Volume A, Page 27, Map Records, Nueces County, Texas, being further described as follows: BEGINNING at a point being the northwest corner of said Lot 48; THENCE North 58°54' West 10.64 feet to a point for the northmost corner of this tract; THENCE South 11°06' East along a line that is 10 feet east of and parallel to the existing west right-of-way of said San Antonio Street a distance of 196.91 to a point of curvature of a circular curve to the right; THENCE in a southerly direction along the arc of said curve whose central angle equals 70°, radius equals 12.33 feet, a distance of 15.05 feet to a point being the southmost corner of this tract and being a point on the east right-of-way of Floyd Street; THENCE North 31°06' West along said Floyd Street right-of-way 30.03 feet to a point; THENCE North 58°54' East 6.65 feet to a point for an interior corner of this tract; THENCE North 11°06' West 175.61 feet to the point of beginning and containing 0.048 acres (2090.07 square feet) more or less.
