AUTHORIZING THE EXECUTION OF A CONTRACT WITH CAT
CONTRACTING, INC. & MICHIGAN SEWER CONSTRUCTION COMPANY, A
JOINT VENTURE, FOR THE RELOCATION OF CITY UTILITY LINES TO
FACILITATE IMPROVEMENTS TO INTERSTATE HIGHWAY 37;
AUTHORIZING THE EXECUTION OF AMENDMENT NO. 3 TO THE
ENGINEERING SERVICES CONTRACT WIT}I S. A. GARZA ENGINEERS,
INC. FOR THE I.H. 37 UTILITY ADJUSTMENTS, PHASE B, PROJECT
WHICH PROVIDES FOR COMPENSATION OF $53,800 FOR ADDITIONAL
DESIGN FEES, SUBJECT TO APPROVAL BY THE STATE DEPARTMENT OF
HIGHWAYS AND PUBLIC TRANSPORTATION; APPROPRIATING
$1,996,204.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute a
contract with CAT Contracting, Inc. & Michigan Sewer Construction Company,
Joint Venture, for the relocation of City utility lines to facilitate
improvements to Interstate Highway 37, all as more fully set forth in plans and
specifications and contract documents on file in the office of the City
Secretary, all of which are made a part hereof by reference and according to the
bid of CAT Contracting, Inc. & Michigan Sewer Construction Company, a Joint
Venture, said bid being the lowest and most advantageous to the City of Corpus
Christi.
SECTION 2. That the City Manager is hereby authorized to execute
Amendment No. 3 to the engineering services contract with S. A. Garza Engineers,
Inc. for the I. H. 37 Utility Adjustments, Phase B, project which provides for
compensation of $53,800 for additional design fees, subject to approval by State
Department of Highways and Public Transportation, a substantial copy of which
amendment is attached hereto as Exhibit A.
SECTION 3. That there is hereby appropriated $1,889,027 from the
No. 205 Water Bond Fund and authorizing a transfer of $30,404 from Gas Fund
No. 106-362-542.11-437 to the Water Bond Fund Project No. 205-81-44-16.2; and
that there is hereby appropriated $76,773 from the 250 Sanitary Sewer Bond Fund
applicable to Project No. 250-87-44-6.1, I. H. 37 Utility Adjustments, Phase B,
(Sanitary Sewer) for a total of $1,996,204 of which $1,798,943 is for the
contract award, $53,800 is for Amendment No. 3 to the Engineering Services
Contract, and $143,461 is for additional engineering, contingencies, testing,
printing, legal advertising and incidental and related expenses, a portion of

Transportation as per Utility Agreement No. U-7438 dated October 2, 1987.

AMENDMENT NO. 3 TO THE CONTRACT FOR ENGINEERING SERVICES FOR
I.H. 37 WATER LINE RELOCATIONS AND UTILITY ADJUSTMENTS

The City of Corpus Christi, hereinafter called "City" and S.A. Garza
Engineers, Inc., hereinafter called "Engineer", hereby agree to the following
amendment to the Contract for Engineering Services for the Interstate Highway
37 Water Line Adjustments and Utility Relocations project which was authorized
by Ordinance No. 18062, passed February 1, 1984, and amended by Ordinance No.
18992, passed August 27, 1985, and Ordinance No. 19454, passed August 26,
1986.
Section III, Payment, shall be amended to provide additional compensation
to the Engineer for work on the Project B portion in the amount of Fifty Three
Thousand Eight Hundred and no/100 Dollars ($53,800.00) for a total
compensation for Project B of One Hundred Twenty One Thousand Eight Hundred
and no/100 Dollars ($121,800.00) and a total compensation under the contract
of One Hundred Seventy Five Thousand Six Hundred Twenty Five and no/100
Dollars ($175,625.00).
All other items and conditions of the contract, between the City and
Engineer, as approved on February 1, 1984, and amended on August 27, 1985, and
August 26, 1986, not specifically addressed herein, shall remain in full force
and effect.
Executed in duplicate, each of which shall be considered an original,
