HomeMy WebLinkAbout020155 ORD - 01/05/1988AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF MONTGOMERY WARD DEVELOPMENT CORPORATION BY GRANTING A SPECIAL COUNCIL PERMIT FOR A MONTGOMERY WARD AUTOMOTIVE SERVICE CENTER ON LOTS 1, 2, AND 36, BLOCK 2, KOOLSIDE ADDITION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Montgomery Ward Development Corporation, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, January 5, 1988, during a meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lots 1, 2, and 36, Block 2, Koolside Addition, situated in the City of Corpus Christi, Nueces County, Texas, for a Montgomery Ward Automotive Service Center with the following 7 conditions, and according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit A, and subject to all other considerations of "B-1" Neighborhood Business District: 1. That one driveway access be allowed on the northernmost lot (Lot 36) in addition to the existing curb cut on Dorthy, and that the existing driveway cut on McArdle Road closest to Dorthy Street be removed; 2. That a standard screening fence be constructed along abutting residentially zoned property at the north end of the property (between Lots 36 and 35) and along a portion of the western property line (between Lot 36 and Lot 34); 205rp020.ord 201sMICROFILMED 3. That a 5' buffer yard be planted adjacent to the screening fence with 2-1/2" caliper live oak trees planted 30' on center; 4. That all paved areas be buffered from both Dorthy Street and McArdle Road by an effective visual landscape screen of at least 2' in height; 5. That on -street parking be prohibited along Dorthy Street; 6. That signage be limited to that allowed in the "B-1" District; 7. That all lighting be directed from the adjacent residential area. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
