EVIDENCING THE CITY OF CORPUS CHRISTI'S COMMITMENT OF
FINANCIAL RESPONSIBILITY FOR THE OPERATION OF THE SOLID
WASTE DISPOSAL SITE AT THE J. C. ELLIOTT SANITARY LANDFILL.
WHEREAS, the City of Corpus Christi, Texas, (hereinafter, "City") must
make plans for proper disposition of municipal solid waste and to maintain
adequate facilities for doing so; and
WHEREAS, such activity is undertaken to provide for the general
health, safety, and welfare; and
WHEREAS, the City has purchase a 156.21 acre tract of land situated in
Nueces County, Texas, adjacent to the present J. C. Elliott Landfill as shown on
attached Exhibit A;
WHEREAS, the City intends, desires, and is firmly committed to use and
operate this tract as a municipal solid waste disposal site (hereinafter,
"Site") to the extent needed and as permitted by law; and
WHEREAS, the City has sufficient assets to properly operate the Site
and to provide proper closure for this facility, which is to be publicly owned;
and
WHEREAS, the City is fully competent to operate the site, having
extensive experience in the operation of other municipal solid waste disposal
sites and as further evidenced by the documents which have been or will be
submitted to the Texas Department of Health showing the experience of key
operating personnel and the numbers, makes, models, and condition of equipment
to be dedicated to the operation of this Site; and
WHEREAS, the Charter of the City of Corpus Christi and the ordinances
of such City charge the City Council with the responsibility to acquire and
manage the solid waste disposal system of the City of Corpus Christi; and
WHEREAS, the City is firmly committed to provide backup equipment by
lease, purchase, or diversion from other activities if such backup equipment is
required to properly operate the Site; and
WHEREAS, the rules of the Texas Department of Health as promulgated on
Page E41 of the December 1986 issue of the Municipal Solid Waste Management
Regulations require that the City Council certify that it has the funds to
provide for the proper closure of the solid waste disposal site and to maintain
same in accordance with the rules and regulations of the Texas Department of
Health and agrees to apply such funds to such purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:

SECTION 1. That the City Council of the City of Corpus Christi,
acting under the Charter of such City, hereby evidences its assurances to the
Texas Department of Health that it has sufficient assets to properly operate the
Site as authorized under Permit Application No. 423 to be issued by the Texas
Department of Health, that it has sufficient assets to provide for proper
closure of the Site which is to be publicly owned, and it does hereby agree to
use the amount of utility funds required to comply with the requirements of such
permit if and when same is approved and issued.
