HomeMy WebLinkAbout020188 RES - 02/02/1988A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH CORPUS CHRISTI JUNIOR COLLEGE DISTRICT RELATIVE TO STREET SYSTEM IMPROVEMENTS SURROUNDING THE DEL MAR COLLEGE EAST CAMPUS, INCLUDING IMPROVEMENTS TO NAPLES AND EDWARDS STREETS AND THE REALIGNMENT OF KOSAR STREET; AND APPROPRIATING $19,873. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with Corpus Christi Junior College District relative to street system improvements surrounding the Del Mar College East Campus, including improvements to Naples and Edwards Streets and the realignment of Kosar Street all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That there is hereby appropriated $19,873 from the No. 295 Storm Sewer Bond Fund as the City's participation in underground storm sewer work associated with the Edwards Street improvements, applicable to Project No. 295-88-44-2.1, Del Mar Storm Sewer Construction. HAL GEORGE, CITY ATTORNEY Assistant City Attorne 205RP070.res THE CITY OF CORPUS CHRISTI, TEXAS , 19ff noise MICROFILMED AGREEMENT THE STATE OF TEXAS § COUNTY OF NUECES § This agreement is entered into by and between the City of Corpus Christi, Texas, hereinafter called "City" and the Corpus Christi Junior College District, hereinafter called "College", and relates improvements to the street system surrounding Del Mar College East Campus. WHEREAS, the College has embarked upon a major expansion and improvement program for Del Mar College East Campus which will impact the traffic volumes and circulation patterns on the City streets surrounding the campus, and WHEREAS, the City and College desire to implement improvements to the street system surrounding the campus; NOW, THEREFORE, the City and College agree as follows: 1. The desired improvements and their order of priority are: a. The installation of an underground storm sewer line from the existing system within the abandoned Shely Street right-of-way, along the abandoned Lewis Street right-of-way to the intersection of Lewis and Edwards Streets, b. Edwards Street, Ayers Street to Naples Street. Reconstruct to a 40' back to back of curb cross-section with sidewalks on both sides of the street, c. Naples Street, Edwards Street to Kosar Street. Reconstruct to a 40' back to back of curb cross-section with sidewalks on both sides of the street, d. Realign Kosar Street, from Naples Street to S. Staples Street, to provide smoother access to the College from Staples, all as shown on Exhibit "A" attached hereto and made a part hereof. 2. The City and College desire that the improvements be constructed and completed in conjunction with the major improvements to the East Campus of the College currently- under construction or commencing construction during 1988. Therefore, time is of the essence for the completion of the improvements in accordance with the following completion schedule: a. Storm sewer extension in abandoned Lewis Street right-of-way to be completed by December 31, 1988. b. Edwards Street improvements to be completed by December 31, 1989. c. Naples Street improvements to be completed by December 31, 1989. d. Realignment of Kosar Street to be completed by December 31, 1990. Should this completion schedule not be met through no fault of either party, the completion dates shall be re-established by mutual consent of both parties. The estimated cost of these improvements, including engineering, construction and contract administration is as shown on Exhibit "B" attached hereto and made a part hereof. 4. Due to the College's completion schedule for the parking lots adjacent to Lewis Street, the storm sewer along the abandoned Lewis Street right-of-way must be installed prior to the completion of the parking lots and the Edwards Street improvements. The College will include this work with the parking lot construction. The cost of this work has been established at $18,573.00 for the construction, and $1,300.00 for engineering services. 5. The cost of the improvements to Edwards and Naples shall be apportioned as shown on Exhibit "C", attached hereto and made a part hereof. In summary, the City will pay the costs associated with utility adjustments and installation of the storm drainage system; the City will assess abutting property owners other than the College a proportionate share of the cost of pavement, curb and gutter, sidewalks and driveways in accordance with the current assessment policies and ordinances of the City; and the College shall pay remaining costs as set forth in Exhibit "C". 6. The total estimated cost for the realignment of Kosar Street is $213,000. The City has allocated a total of $200,000. The College's estimated share of the cost of this realignment is $13,000. 7. Except for the storm sewer extensions along the abandoned Lewis Street right-of-way, the City will prepare, or cause to be prepared, the detailed plans and specifications for the work, receive bids, award the contract and provide construction inspection and contract administration services. The College will prepare, or cause to be prepared, the detailed plans and specifications for the storm sewer extension, acceptable to the City and will cause the work to be performed in conjunction with other work being performed by the College. 8. The estimates and apportionment of costs shown herein and on Exhibits "B" and "C" are approximate and shall be adjusted to reflect actual construction costs, assessments and administrative costs incurred as calculated upon completion and acceptance of the work. In the event that the total of the low bid received plus estimated related expenses (engineering, testing, construction inspection, legal advertising, etc.) is ten percent (10%) or greater than the estimated costs shown herein and on Exhibits "B" and "C", no further work will proceed unless this agreement is amended by mutual consent of both parties. Expenses incurred up to the receipt of bids shall be pro -rated based upon each parties estimated percentage contribution to the project. For the purposes of this calculation, the City's percentage contribution shall include the property owner assessments. 9. The College shall, prior to the award of any contract for construction of Edwards Street, Naples Street or the realignment of Kosar Street, remit to the City its estimated share of the funding for that phase of the work. The City shall, prior to the award of any contract or issuance of any change order for the construction of the storm sewer extension in the abandoned Lewis Street right-of-way remit to the College the total estimated cost of such work. Agreement Corpus Christi Junior College District Page 2 of 3 10. The College and the City enter into this agreement pursuant to Article 4413 (32c), Interlocal Cooperation Act, as amended. Neither party shall be responsible to the other for personal injuries, losses, claims, or demands caused by the acts or omissions, if any, of such party or its agents, employees, invitees, or subcontractors. The liability, if any, of either party shall be that prescribed by the laws of the State of Texas. 11. The Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto. This Agreement is solely for the benefit of the College and the City, and is not for the benefit of any third party. EXECUTED IN DUPLICATE, this the day of , 1988.
