HomeMy WebLinkAbout020191 ORD - 02/02/1988AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION OF STORY FARMS COMPANY BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 9A, BLOCK 5, SHERWOOD PARK SUBDIVISION FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT ON TRACT 1 AND GRANTING A SPECIAL PERMIT FOR A LANDSCAPED BUFFER AREA ON TRACT 2; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Story Farms Company for amendment to the zoning map of the City of Corpus Christi. WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 13, 1987, during a meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning on Lot 9A, Block 5, Sherwood Park Subdivision, in the City of Corpus Christi, Nueces County, Texas, be changed from "R -1B" One -family Dwelling District to "AB" Professional Office District on Tract 1 and granting a special permit for a landscaped buffer area with the following four conditions on Tract 2, which tracts are more fully described by metes and bounds descriptions attached hereto as Exhibits A and B, and according to the Site Plan attached hereto as Exhibit C, and subject to all other considerations of "R -1B" One -family Dwelling District: 1. That a standard screening fence be constructed on the 25 ft. setback line off Chester Drive; 2. That the buffer area be landscaped with a minimum of six (6) Live Oak Trees of 2-1/2" caliper to be spaced 40 ft. apart; 3. That the green area be irrigated and maintained by the owner of the office development; and 205RP063.ord zoisi MICROFILMED 4. That no driveway access be permitted to Chester Drive. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for efficient administration of City affairs by granting the aforesaid zoning change, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of 19 . ATTEST: City Secretary U M APPROVED:o?andDAY OF 55-9N, , 19 gr HAL GEORGE, CITY ATTORNEY 205RP063.ord THE CITY OF CORPUS CHRISTI, TEXAS STATE OF TEXAS January 20, 1988 COUNTY OF NUECES TRACT 1 A tract of land being a portion of Lot 9A, Block 5, Sherwood Park as shown on the map thereof, recorded in Volume 53, Page 121 of the Map Records of Nueces County, Texas, said tract being more particularly described by metes and bounds as follows: COMMENCING at the intersection of the centerline of Robinhood Drive and the centerline of Chester Drive, each having a right-of-way width of 50.00 feet; THENCE with the centerline of Chester Drive South 28°20' West 275.00 feet to a point; THENCE North 61°40' West, at 25.00 feet pass a 5/8 inch iron rod monumenting the northeast corner of Lot 9A and the west boundary of Chester Drive, in all 50.00 feet to a point on the north boundary of Lot 9A for the northeast corner and POINT OF BEGINNING of the tract herein described; THENCE South 28°20' West parallel to the west boundary of Chester Drive 240.00 feet to a point on the south boundary of Lot 9A for the southeast corner of this tract; THENCE with the south boundary of Lot 9A North 61°40' West 215.00 feet to a 5/8 inch iron rod for the southwest corner of Lot 9A and the southwest corner of this tract, also being a point on the east boundary of Weber Road; THENCE with the common boundary of Lot 9A and Weber Road North 28°20' East 240.00 feet to a 5/8 inch iron rod for the northwest corner of Lot 9A and the northwest corner of this tract; THENCE with the north boundary of Lot 9A South 61°40' East 215.00 feet to the POINT OF BEGINNING, containing in all 51,600 square feet, more or less.
