AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE GREENWOOD
CONGREGATION OF JEHOVAH'S WITNESSES, OWNER OF LOT 1-E,
BLOCK 2, SOUTHLAND ESTATES SUBDIVISION, RELATIVE TO CITY
PARTICIPATION IN THE CONSTRUCTION OF APPROXIMATELY 190
LINEAR FEET OF RICHTER STREET; AND APPROPRIATING $9,900.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute an
agreement with the Greenwood Congregation of Jehovah's Witnesses, owner of
Lot 1-E, Block 2, Southland Estates Subdivision, relative to City participation
in the construction of approximately 190 linear feet of Richter Street, all as
more fully set forth in the agreement, a substantial copy of which is attached
hereto and made a part hereof, marked Exhibit A.
SECTION 2. That there is hereby appropriated $9,900 from the No. 561
Street Bond Fund applicable to Project No. 561-86-5.2, Southland Estates/Richter
Street Improvements.

This Agreement is entered into between the City of Corpus Christi, Texas,
hereinafter referred to as "City", and the Greenwood Congregation of Jehovah's
Witnesses, hereinafter referred to as "Owner", and pertains to the platting
and development of Lot 1-E, Block 2, Southland Estates.
WHEREAS, the Owner is required under the Platting Ordinance to dedicate
and construct the east portion of Richter Street along the westernmost
boundary of this tract as shown on Exhibit "A" attached; and
WHEREAS, the Owner desires to construct the full width of Richter Street
in lieu of the partial street for practical reasons; and
WHEREAS, the City owns the property abutting the proposed street to the
west, and therefore recognizes its obligation towards the cost of the west
portion of the street;
NOW, THEREFORE, the City and Owner agree as follows:
1. The Owner shall construct approximately 190 feet of Richter Street
as a 40 foot back of curb to back of curb street in accordance with the plans
and specifications for Lot 1-E, Block 2, Southland Estates, approved by the
Director of Engineering Services.
2. The City shall reimburse the Owner its prorata share of the
construction and engineering costs of Richter Street based on the estimated
construction cost. City reimbursement to the Owner shall not exceed Nine
Thousand Nine Hundred and no/100 Dollars ($9,900.00). Actual reimbursement
shall be adjusted according to actual construction costs but shall not exceed
the above stated amount. Actual reimbursement shall be based on:
a) Material invoices.
b) Equipment rental invoices and/or equipment rental rates as
established by the City Street Division which are attached
marked Exhibit "B".
c) Labor rates as established by Federal Wage Rates which are
attached marked Exhibit "C".
The Owner shall provide all documentation necessary for actual
reimbursement. This shall include all invoices and other documentation as
follows:

Engineering costs shall be 71% of the actual construction cost. Reimbursement
shall be made after completion and acceptance of the subdivision improvements.
3. The City shall sign and record the final plat of Lot 1-E, Block 2,
Southland Estates, when the Richter Street construction and related water and
sewer construction are completed and accepted and all platting requirements
have been met.
4. The Owner shall indemnify and save harmless and defend the City, its
officers, agents, and employees against any and all lawsuits, claims, demands,
liabilities, losses or expenses, including court costs and attorney's fees,
for or on account of any injury of'any person, or any death at any time
resulting from such injury, or damage to any property, which may arise or
which may be alleged to have arisen out of or in connection with this project.
5. The Owner further agrees, in compliance with City Ordinance No.
17112, to complete, as part of this agreement, the Disclosure of Interests
form attached hereto and labeled Exhibit "D".
6. This Agreement shall be executed in duplicate, both of which shall
be considered one instrument, and shall become effective and be binding upon
and inure to the benefit of the parties hereto from and after the date of
execution.
