HomeMy WebLinkAbout020214 RES - 02/16/1988A RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO 8 OF THE PARCELS OF LAND IN CONNECTION WITH THE TEXAS STATE AQUARIUM PROJECT WHICH WERE SPECIFIED IN THE CONTRACT AUTHORIZED BY ORDINANCE NUMBER 19619. WHEREAS, it is necessary to acquire, for and on behalf of the City, certain parcels of land, more fully described hereinafter; and WHEREAS, the Aquarium Land Acquisition Project requires the acquisition of fee simple title in and to the said parcels and acquire said parcels from the Owners; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owners and claimants as to the price and value of said parcels and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that the said parcels be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the Aquarium Land Acquisition Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcels of land, excluding mineral interest, said parcel being described by metes and bounds as follows: Parcel 2 All of Lot 7, Block 45, BROOKLYN, an addition to the City of Corpus Christi, Nueces, County, Texas, as shown by map thereof recorded in Volume A, page 30 - 32, Map Records, Nueces County, Texas, lying east of the San Antonio and Aransas Pass Railway Company, being the same property conveyed to Harold T. Hartgraves by James L. Green and wife, Jimmye Louise Green, by deed dated March 1, 1980, recorded in Volume 1750, page 990, Deed Records, Nueces County, Texas. Parcel 3 All of Lot 9, Block 45, BROOKLYN, an addition to the City of Corpus Christi, Nueces County, Texas, as shown by map thereof recorded in Volume A, page 30 - 32, Map Records, Nueces County, Texas, lying East of the San Antonio and Aransas Pass Railway Company, being the same property 20214 MICROFILMED conveyed to Harold T. Hartgraves by James L Green and wife, Jimmye Louise Green, by deed dated March 1, 1980, recorded in Volume 1750, page 990, Deed Records, Nueces County, Texas. Parcel 4 All of fractional Lot Eleven (11), Block Forty-five (45), BROOKLYN, an addition to the City of Corpus Christi, Nueces County, Texas, lying east of the San Antonio and Aransas Pass Railway Company, according to the map or plat recorded in Volume A, pages 30 - 32, Map Records, Nueces County, Texas, and being the same property conveyed to Verna Hamilton by Lile Kent Hamilton and Martha E. Hamilton, by deed dated April 23, 1981, recorded in Volume 1778, page 941, Deed Records, Nueces County, Texas. Parcel 7 The south ten (10) feet of Lot 117, all of Lot 118, Block 43, Corpus Beach Hotel Addition, an addition to the City of Corpus Christi, Nueces County, Texas, a map thereof appearing of record in Volume 1, page 51, Map Records, Nueces County, Texas; also known as Lots 5 and 7, Block 43 BROOKLYN (Lot 117) and Lots 1 and 3, Block 43 BROOKLYN (Lot 118), an addition to the City of Corpus Christi, Nueces County, Texas, being the property conveyed to J. N. Bogart by K. Sebastian, by deed dated August 5, 1952, recorded in Volume 563, page 157, Deed Records, Nueces County, Texas. Parcel 11 Lots No. 6 and 8, Block No. 3, BROOKLYN, an addition to the City of Corpus Christi, Nueces County, Texas, as shown by map thereof recorded in Volume A, pages 30 - 32, Map Records, Nueces County, Texas, and being the same property conveyed to Adolf and Lucille Fellman by Wilma Gertrude Atkins, by deed dated March 21, 1977, recorded in Volume 1600, page 427, Deed Records, Nueces County, Texas. Parcel 15 Lot Number 147 in Block "F", CORPUS BEACH HOTEL ADDITION, an addition to the City of Corpus Christi, Nueces County, Texas, as shown by plat or map thereof recorded in Volume 1, page 51, Map Records, Nueces County, Texas; formerly known as Block "F" in BROOKLYN, an addition to the City of Corpus Christi, being the same property conveyed to Nathan B. Clark by Nathan L. Clark by gift deed dated December 24, 1975, recorded in Volume 1551, page 625, Deed Records, Nueces County, Texas and by Correction Gift Deed dated November 12, 1981, to Nathan B. Clark from Nathan L. Clark, recorded in Volume 1802, page 298, Deed Records, Nueces County, Texas. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes.
