AMENDING THE CITY CODE, SECTION 2101.9 OF THE BUILDING CODE
ADOPTED BY ORDINANCE NO. 19287 TO PROVIDE THAT BID DOCUMENTS
AND CONTRACTS INCLUDE DETAILED PLANS AND SPECIFICATIONS FOR
TRENCH SAFETY SYSTEMS; PROVIDING FOR SEVERANCE; AND
PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code, Section 1201.9 of the Building Code
adopted by Ordinance No. 19287, approved by the City Council on April 29, 1986,
is hereby amended by adding a new paragraph designated as "2101.9.5" to
hereafter read as follows:
2101.9.5 Trench Safety. On all construction projects, public or
private, within the boundaries of the City, in which trench excavation
will exceed five feet in depth, the bid documents and the contract
shall contain: (1) detailed plans and specifications for adequate
safety systems that meet federal Occupational Safety and Health
Administration standards, and (2) a pay item for those safety systems.
This requirement shall not apply to persons subject to safety
standards adopted under Article 6053-1, V.T.C.S., and the
administrative penalty provisions of Article 6053-2, V.T.C.S.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
