CLOSING AND ABANDONING A 10 -FOOT WIDE BY 150 -FOOT LONG
UTILITY EASEMENT ALONG THE COMMON LOT LINE OF LOTS 2 AND 36,
BLOCK 2, KOOLSIDE ADDITION, SUBJECT TO THE PROVISIONS LISTED
BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 10 -foot wide by 150 -foot long utility easement
along the common lot line of Lots 2 and 36, Block 2, Koolside Addition, recorded
in Volume 13, Pages 32 and 33, Map Records of Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easement, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That a 10 -foot wide by 150 -foot long utility easement
along the common lot line of Lots 2 and 36, Block 2, Koolside Addition, as
recorded in Volume 13, Pages 32 and 33, and further described by metes and
bounds attached hereto as Exhibit A, be and the same is hereby closed for public
use and every municipal purpose, subject to applicant paying all costs
associated with the relocation of an existing 2 -inch City gas line and subject
to the property being replatted at applicant's expense within 180 days of the
passage of this ordinance. The above described utility easement is hereby
abandoned to the owners of the abutting property in accordance with the laws of
the State of Texas, and for the service and interest of the inhabitants of the
City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned at the earliest practicable date, such
finding of an emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances at three regular meetings so
that this ordinance is passed and shall ake effect upo first reading as an
emergency measure this the 5"01 day of , 19i?

BEING a tract of land designated as a 10 -foot wide utility easement out of
Lot 36 and Lot 2, Block 2, Koolside Addition, as shown on the map thereof
recorded in Volume 13, Pages 32 and 33, of the Map Records of Nueces County,
Texas, said tract being more particularly described by metes and bounds as
follows:
COMMENCING at a 5/8 inch iron rod monumenting the northwest corner of said
Lot 36, from which the west boundary of Dorthy Drive bears South 72°43'39"
East along the boundary of Lot 36 and the north boundary of McArdle Road bears
South 29°20' West 197.90 feet along the boundaries of Lot 36, Lot 2 and Lot 1;
THENCE with the west boundary of Lot 36 South 29°20' West 52.89 feet to a
point from which the common rear corner of Lot 36 and Lot 2 bears South 29°20'
West 5.01 feet and South 64°23'34" East 20.00 feet to the northwest corner and
the POINT OF BEGINNING of the tract herein described;
THENCE South 64°23'34" East parallel to the common boundary of Lot 36 and
Lot 2 and at a perpendicular distance of 5.00 feet therefrom 127.14 feet to a
point on the east boundary of Lot 36, being a circular curve to the right
having a radius of 531.78 feet, the radius thereof bearing North 73°42'38"
West from said point, for the northeast corner of this tract;
THENCE with the said circular curve to the right and the common boundary of
Dorthy Drive and Lots 36 and 2, at an arc distance of 5.13 feet pass the
common front corner of Lot 36 and Lot 2, in all an arc distance of 10.26 feet
to a point for the southeast corner of this tract, from which the radius bears
North 72°36'17" West;
THENCE North 64°23'34" West parallel to the common boundary of Lot 36 and
Lot 2 and at a perpendicular distance of 5.00 feet therefrom 129.37 feet to a
point for the southwest corner of this tract;
THENCE North 29°20' East 10.02 feet to the POINT OF BEGINNING, containing in
all 1283 square feet, more or less.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
