APPROVING CHANGE ORDER NO. 1 TO THE CONTRACT WITH CAT
CONTRACTING, INC. AND MICHIGAN SEWER CONSTRUCTION COMPANY, A
JOINT VENTURE, PROVIDING FOR THE INSTALLATION OF A 48 -INCH
DIAMETER WATERLINE ALONG THE RELOCATED SHARPSBURG ROAD AND
THE EXTENSION OF BORED CASINGS UNDER THE MISSOURI PACIFIC
RAILROAD TRACKS; AUTHORIZING THE EXECUTION OF AMENDMENT
NO. 4 TO THE ENGINEERING SERVICES CONTRACT WITH S. A. GARZA
ENGINEERS, INC. PROVIDING FOR INCREASED COMPENSATION FOR
PLAN REVISIONS ASSOCIATED WITH CHANGE ORDER NO. 1 TO THE
CONSTRUCTION CONTRACT; AND APPROPRIATING $183,000.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That there is hereby approved Change Order No. 1 to the
contract with Cat Contracting, Inc. and Michigan Sewer Construction Company, a
Joint Venture, providing for the installation of a 48 -inch diameter waterline
along the relocated Sharpsburg Road and the extension of bored casings under the
Missouri Pacific Railroad tracks.
SECTION 2. That the City Manager is hereby authorized to execute
Amendment No. 4 to the Engineering Services Contract with S. A. Garza Engineers,
Inc. providing for increased compensation for plan revisions associated with
Change Order No. 1 to the construction contract, all as more fully set forth in
the amendment, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit A.
SECTION 3. That there is hereby appropriated $183,000 from the
No. 205 Water Bond Fund of which $174,163.13 is for the change order work,
$8,214.48 is for the amendment to the Engineering Services Contract, and $622.39
is for staff engineering and related expenses, subject to approval by the State
Department of Highways and Public Transportation and 100 percent reimbursable as
per Utility Agreement No. U-7438 dated October 2, 1987, applicable to Project
No. 205-81-44-16.2, I.H. 37 Utility Adjustments, Phase B.

I.H. 37 WATER LINE RELOCATIONS AND UTILITY ADJUSTMENTS

The City of Corpus Christi, hereinafter called "City" and S.A. Garza
Engineers, Inc., hereinafter called "Engineer", hereby agree to the following
amendment to the Contract for Engineering Services for the Interstate Highway
37 Water Line Adjustments and Utility Relocations project which was authorized
by Ordinance No. 18062, passed February 1, 1984, and amended by Ordinance No.
18992, passed August 27, 1985, Ordinance No. 19454, passed August 26, 1986,
and Resolution No. 20135, passed December 29, 1987.
Section III, Payment, shall be amended to provide additional compensation
for revisions to the Phase B Contract Documents associated with construction
contract Change Order No. 1 in' the amount of Eight Thousand Two Hundred
Fourteen and 48/100 Dollars ($8,214.48) for a total compensation for the Phase
B project of One Hundred Thirty Thousand Fourteen and 48/100 Dollars
($130,014.48) and total compensation under the contract of One Hundred Eighty
Three Thousand Eight Hundred Thirty Nine and 48/100 Dollars ($183,839.48).
All other items and conditions of the contract, between the City and
Engineer, as approved on February 1, 1984, and amended on August 27, 1985,
August 26, 1986, and December 29, 1987, not specifically addressed herein,
shall remain in full force and effect.
Executed in duplicate, each of which shall be considered an original,
