AMENDING SECTION 13-1 OF THE CODE OF ORDINANCES,
ENTITLED "STANDARD BUILDING CODE ADOPTED; AMENDMENTS,"
BY AMENDING SECTIONS 3401, 3402, AND 3403 AND ADDING
SECTION 3404; PROVIDING FOR SEVERANCE; PROVIDING FOR
PUBLICATION BY NOTICE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 13-1 of the Code of Ordinan-
ces, entitled "Standard Building Code Adopted; amendments," is
hereby amended by amending Sections 3401, 3402, and 3403 and
adding a new Section 3404, which shall read as follows:
Chapter XXXIV--LOCATIONS OF BUILDINGS
NEAR OIL AND GAS WELLS
Section 3401 --General.
The presence of oil and gas wells within the City of
Corpus Christi presents the risk of blow -outs and
explosions which would endanger the lives of occupants
in any buildings in proximity to wells. The presence
of oil and gas wells, water wells, or cisterns which
are not in actual use by the owner thereof also present
risks to life. The fire prevention code: prohibits open:
flames around wells. This chapter regulates the
location of buildings in proximity to oil and gas wells
in order to provide for the safety of building occu-
pants and regulates the covering and plugging of wells
and cisterns which are not in actual use.
Section 3402 --Buildings Prohibited Within One Hundred
Fifty Feet of Active Wells.
3402.1. No habitable building shall be constructed or
allowed to stand within one hundred fifty (150) feet of
an oil and gas well which has not been plugged and
abandoned according to the ordinances and regulations
of the City of Corpus Christi, except buildings
directly associated with the production from such a
well.
3402.2. Any oil or gas well which was plugged and
abandoned prior to May 29, 1968, with mud or only a
bottom plug shall be considered to be unsafe for the
location of any building within fifty (50) feet there-
of, until such well has been covered and plugged in
compliance with Section 3404 below, and no such build-
ing shall be constructed or allowed to stand until such
well has been appropriately covered and plugged.

Section 3403 --Natural Gas Seepage Areas.
In any area characterized by seeping methane gas at
the surface of the ground, it shall be unlawful for any
building to be constructed unless such building shall
be provided with ventilation for the purpose of pro-
tecting against any accumulation of explosive gases
within and under the building. Such ventilation system
shall be designed by an engineer who shall submit a
statement with the application for the building permit
to the effect that the design of the ventilation system
was prepared in accordance with this Section.
Section 3404 --Covering and Plugging Well or Cistern
3404.1. It shall be unlawful for the owner or opera-
tor of any well or cistern which is at least ten (10)
feet deep, and at least five (5) inches in diameter but
not more than six (6) feet in diameter to fail to keep
it entirely covered at all times with a covering
capable of sustaining weight of not less than two
hundred (200) pounds, except when said well or cistern
is in actual use by the owner or operator thereof.
3404.2. It shall be unlawful for any person who shall
drill, dig, or otherwise create or cause to be drilled,
dug, or otherwise created, any well or hole which is at
least ten (10) feet in depth and less r:u than five (5)
inches in diameter to abandon said well or hole without
first completely filling said well or hole from its
total depth to the surface or plugging the same with a
permanent type plug at a depth of not less than ten
(10) feet from the surface and completely filling the
same from said plug to the surface.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word, or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word, or provi-
sion of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause,
phrase, word, or provision hereof be given full force and effect
for its purpose.
SECTION 3. This ordinance shall take effect upon its
final passage and publication one time in the official publica-
tion of the City of Corpus Christi, which publication shall
contain the caption stating in summary the purpose of the ordi-
nance.
