AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE MUSIC
PERFORMANCE TRUST FUND FOR ELEVEN 1988 SUMMER CONCERTS TO BE
PERFORMED AT THE COLE PARK AMPHITHEATER.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute an
agreement with the Music Performance Trust Fund for eleven 1988 summer concerts
to be performed at the Cole Park Amphitheater by the Corpus Christi Musicians
Association, Inc., Local 644, all as more fully set forth in the agreement, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit A.

That this Agreement, made and entered into on this the day of
, •1988, by and between the City of Corpus Christi, a municipal
corporation, hereinafter referred to as "City", and the Music Performance
Trust Fund, 1501 Broadway, Suite 315, New York City, New York, hereinafter
called "MPTF":
WITNESSETH
The MPTF has agreed to provide eleven (11) concerts to be held in
the Cole Park Amphitheater on the following dates in 1988:
June 5, 12, 19 and 26: July 3, 10, 17, 24 and 31: August
7, 14, 1988 for the benefit and enjoyment of the citi-
zens of Corpus Christi.
In consideration of providing music for these performances, the City
agrees to pay the MPTF the some of Eleven Thousand Two Hundred Dollars
($11,200). Payment up to the agreed sum is to be made on presentation
of requests for payment submitted at the end of each month at the rate
of One Thousand Eighteen Dollars and Eighteen Cents ($1,018.18) per perfor-
mance held during the month.
In addition to the concert funding, the City further agrees to provide
use of facilities for these performances through the Park and Recreation
Department.
The City further agrees to provide the transportation of music stands
and musical instruments before and after each outdoor concert. Transpor-
tation will be between Del Mar College and the site of the eleven (11)
concerts at Cole Park.
In consideration of the provision of the above program, the MPTF agrees
that expenses will be limited to space rental, professional fees for musi-
cians, musical instruments, sound equipment, exhibits, advertising, printing
and that each concert will be performed by no less than twenty-nine (29)
musicians as provided by MPTF.
MPTF shall recognize the City of Corpus Christi as a contributor on
all advertisements and publications made regarding the activity which is
the subject of this Agreement.
The MPTF further agrees that a statement of revenues and expenditures
and an activity report including the estimated audience for the program
will be submitted to the City within sixty (60) days after August 31, 1988,
so that the application of the above amount to eligible expenses can be
verified and the cost of the event can be sufficiently related to the bene-
fits received by the citizens of Corpus Christi.

MPTF shall fully indemnify, save and hold harmless the City of Corpus
Christi, its officers, employees, and agents against any and all liability,
damage, loss, claims, demands and actions of any nature whatsoever on ac-
count of personal injuries (including, without limitation on the foregoing,
workers' compensation and death claims), or property loss or damage of any
kind whatsoever, which arise out of or are in any manner connected with,
or are claimed to arise out of or be in any way connected with, the perfor-
mance of this Agreement. MPTF shall at its own expense investigate all
such claims .and demands, attend to their settlement or other disposition,
defend all actions based thereon and pay all charges of attorneys and all
other costs and expenses of any kind arising from any such liability, damage,
loss, claims, demands, and actions.
