HomeMy WebLinkAbout020323 ORD - 05/24/1988AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE UTILITY EASEMENT IN LOT 4, PARK PLAZA ANNEX, SUBJECT TO THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide utility easement in Lot 4, Park Plaza Annex, recorded in Volume 43, Page 190, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a 10 -foot wide utility easement in Lot 4, Park Plaza Annex, as recorded in Volume 43, Page 190, Map Records, Nueces County, Texas, further described by metes and bounds attached hereto as Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to the property being replatted at applicant's expense within 180 days of the passage of this ordinance. The above described utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to close and abandon the above-mentioned utility easement at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance 001.ord 20323 MICROFILMED is passed and shall take eegect upon first reading as an emergency measure this the 6/0-h day of way 1951'7 ATTEST: Ci y Secretary ' APPROVED: 12121 DAY OF /14a CITY OF CORPUS CHRISTI, TEXAS HAL GEORGE, CITY ATTORNEY Asestsent City Attorney 001.ord 19 �T METES AND BOUNDS DESCRIPTION UTILITY EASEMENT - LOT 4, PARK PLAZA ANNEX Being a 10 -foot wide strip of land out of Lot 4, Park Plaza Annex, shown by plat in Volume 43, Page 190, Map Records, Nueces County, Texas, being further described by metes and bounds as follows: BEGINNING at a point being the westernmost corner of said Lot 4, being also a point on the northerly right-of-way of 60 -foot wide McArdle Road; THENCE North 28°59' East along the northwest boundary of said Lot 4, 95.00 feet to a point being the northmost corner of this tract and said Lot 4; THENCE South 61°01' East along the northeast boundary of said Lot 4, 10.00 feet to a point; THENCE South 28°59' West 95.06 feet to a point on said McArdle Road right-of-way; THENCE North 61°01' West along said right-of-way 10.00 feet to the POINT OF BEGINNING and containing 0.022 acres, more or less.
