AMENDING THE ZONING ORDINANCE UPON APPLICATION OF PAUL YORK
BY GRANTING A SPECIAL COUNCIL PERMIT FOR AUTOMOTIVE SALES
AND REPAIR WITH SIX CONDITIONS ON LOT 7, GEORGE J. MERRIMAN
SUBDIVISION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Paul York, for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, April 5, 1988, during a meeting
of the City Council in the Council Chamber at City Hall in the City of Corpus
Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on Lot 7,
George J. Merriman Subdivision, situated in the City of Corpus Christi, Nueces
County, Texas, for automotive sales and repair with the following six
conditions, according to the site plan, a copy of which is attached hereto and
made a part hereof, marked Exhibit "A", and subject to all other considerations
of "B-1" Neighborhood Business District.
1. That no access be permitted to and that parking be prohibited along
Delphine Street (this condition is consistent with the current Driveway
Ordinance);
2. That an 8' high brick fence be constructed 10' back of the property line
along Delphine Street;
3. That a 10' wide continuous landscaped green area for visual buffer be
provided along Delphine Street to be irrigated by an underground sprinkler
system and maintained by the property owner;
4. That the 10' landscaped area along Delphine Street include 3" caliper live
oak trees planted at 30' on center;

5. That security lighting be directed away from adjacent residential uses so
not to illuminate or glare on the properties; and
6. That the public address system be prohibited in the special permit area.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
at three regular meetings so that this ordinance is pasand shall take effect

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
