AUTHORIZING THE EXECUTION OF THE DOCUMENTS
NECESSARY FOR THE ACQUISITION OF PARCEL 7 IN
CONNECTION WITH THE MARY CARROLL CHANNEL
WIDENING PROJECT; AND APPROPRIATING $177,000
OUT OF THE NO. 511 STORM SEWER BOND FUND
APPLICABLE TO PROJECT NO. 511-86-5.1, AND
$93,000 OUT OF THE NO. 512 STORM SEWER BOND
FUND APPLICABLE TO PROJECT NO. 512-87-5.1 FOR
A TOTAL OF $270,000 FOR ACQUISITION OF THIS
PARCEL AND NINE OTHER PARCELS TO BE ACQUIRED
FOR THE MARY CARROLL CHANNEL WIDENING
PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager be authorized to
execute the documents necessary for the acquisition of Parcel 7
in connection with the Mary Carroll Channel Widening Project, a
substantial copy of which is attached hereto and made a part
hereof, marked Exhibit "A."
SECTION 2. That there is hereby appropriated
$177,000 out of the No. 511 Storm Sewer Bond Fund applicable to
Project No. 511-86-5.1, and $93,000 out of the No. 512 Storm
Sewer Bond Fund applicable to Project No. 512-87-5.1, for a total
of $270,000 for acquisition of this parcel and nine other parcels
to be acquired for the Mary Carroll Channel Widening Project.

KNOW ALL BY THESE PRESENTS:
COUNTY OF NUECES t
That CHARTER SAVINGS AND LOAN ASSOCIATION of the County
of Nueces, State of Texas, for and in consideration of the
sum of Five thousand Seven hundred Eleven Dollars and no
cents [$5,711.00] to me in hand paid by the City of Corpus
Christi, Nueces County, Texas, the receipt of which is
hereby acknowledged, have granted and conveyed, and by these
presents do grant and convey unto the City of Corpus
Christi, Texas, a municipal corporation duly incorporated
under and by virtue of the laws of the State of Texas, its
successors and legal representatives the free and
uninterrupted use, liberty, privilege, and easement of going
in, on, over, under and along a certain tract of land
situated in Nueces County, Texas and being described as
follows:

BEING a 10 foot wide strip of land out of Tracts A, B and C, Lot 14,
Lokey Subdivision, shown by plat in Volume 7, Page 16, Map Records, Nueces
County, Texas,. and further described as follows:
BEGINNING at a point being South 29° West 37.50 feet from the original
easternmost corner of said Tract C;
THENCE South 29° West 10.00 feet to a point;
THENCE North 61° West at 165.00 feet pass the common lot line of said
Tracts B and C, at 330.00 feet pass the common lot line of said Tracts A and
B, in all a distance of 495.00 feet to a point;
THENCE North 29° East 10.00 feet to a a point for the northmost corner
of this tract;
THENCE South 61° East 495.00 feet to the point of beginning and containing
0.114 acres, more or less. [4,966 square feet]

A map of which is marked "Exhibit A" and attached
hereto and made a part hereof for all purposes.
Together with the free ingress, egress and regress to
and for the City of Corpus Christi, Texas for the purpose of
constructing a public drainage facility and for the purposes
of maintaining, servicing, repairing and inspecting said
public drainage facility under, on and along said tract. This
easement is not exclusive and is subject to all matters of
record as well as to those matters which are apparent on the
ground.
TO HAVE AND TO HOLD, all and singular, the rights and
privileges aforesaid to the City of Corpus Christi, Texas,
its successors and legal representatives, for the proper use
as a DRAINAGE EASEMENT and drainage right-of-way, for so
long as used for such purpose, and if the use for said
easement and way of said uses be ever abandoned, then in
that event, the aforesaid rights and privileges shall cease.
