CLOSING AND ABANDONING A 10 -FOOT WIDE BY
304 -FOOT LONG UTILITY EASEMENT IN LOT 7,
BLOCK 2, COUNTRY CLUB ESTATES UNIT 20,
SUBJECT TO THE PROVISIONS LISTED BELOW; AND
DECLARING AN EMERGENCY.
WHEREAS, there exists a 10 -foot wide by 304 -foot long
utility easement in Lot 7, Block 2, Country Club Estates Unit 20,
recorded in Volume 47, page 148, Map Records of Nueces County,
Texas; and
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said
easement, subject to the provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That a 10 -foot wide by 304 -foot long
utility easement in Lot 7, Block 2, Country Club Estates Unit 20,
recorded in Volume 47, page 148, Map Records, Nueces County,
Texas, further described by metes and bounds attached hereto as
Exhibit A, be and the same is hereby closed for public use and
every municipal purpose, subject to the property being replatted
at applicant's expense within 180 days of passage of this
ordinance, and subject to payment to Central Power & Light
Company of the cost of cable relocation. The above described
utility easement is hereby abandoned to the owners of the
abutting property in accordance with the laws of the State of
Texas, and for the service and interest of the inhabitants of the
City of Corpus Christi, Texas.
SECTION 2. If for any reason any section,
paragraph, subdivision, clause, phrase, word or provision of this
ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not
affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite
intent of this City Council that every section, paragraph,
subdivision, clause, phrase, word or provision hereof be given
full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor
or five Council members, copy attached, to find and declare an
emergency due to the need to close and abandon the
above-mentioned utility easement at the earliest practicable
date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting
upon ordinances at three regular meetings so that this ordinance

Nueces County, Texas:
BEGINNING at the point of intersection of the East boundary line of an existing 10.00 foot
wide utility easement as shown on said recorded map of Lot 7 with the common boundary line of said
Lot 7 and Lot 2, Block 2, Country Club Estates Unit 20, a map of which is recorded in Volume 46,
Page 26 of said Map Records for the Southwest corner of said easement to be closed, from which
corner a 5/8 inch iron rod on the East boundary line of Weber Road (F.M. Road No. 43) for the
Northwest corner of 3aid Lot 2 and the Southwest corner of said Lot 7, bears North 61°28'10" West
10.00 feet;
THENCE North 29°00'00" East, along the East boundary line of said existing easement,
parallel to the East boundary line of Weber Road and 10.00 feet distant therefrom, measured at
right angles thereto, 10.00 feet for the Northwest corner of said easement to be closed;
THENCE South 61°28'10" East 303.92 feet to a point on the West boundary line of another
existing 10.00 foot wide utility easement as shown on said recorded map of Lot 7 for the Northeast
corner of said easement to be closed;
THENCE South 28°31'50" West, along the West boundary line of said existing 10.00 foot
wide utility easement, 10.00 feet for the Southeast corner of said easement to be closed;
THENCE North 61°28'10" West, et 20.00 feet pass a 5/8 inch iron rod at the East corner
of said Lot 2, Block 2 and an inside corner of said Lot 7, Block 2, and continuing North 61°28'10"
West, along the common boundary line of said Lots 2 and 7, in all a distance of 304.00 feet to the
POINT OF BEGINNING.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
