HomeMy WebLinkAbout020345 RES - 06/14/1988A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE TEXAS REHABILITATION COMMISSION FOR REHABILITATIVE SERVICES AND INJURED EMPLOYEE CASE COORDINATION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with the Texas Rehabilitation Commission for the rehabilitative services and injured employee case coordination, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. ATTEST: AYOR APPROVED: .07/ DAY OF /7,79 , 19 Pg HAL GEORGE, CITY ATTORNEY 206RP077.res THE CITY OF CORPUS CHRISTI, TEXAS 20345 MICRON mFo AGREEMENT BETWEEN THE TEXAS REHABILITATION COMMISSION AND THE CITY OF CORPUS CHRISTI Introduction: This agreement is entered into between the Texas Rehabilitation Commission (hereafter referred to as the Commission) and the City of Corpus Christi (hereafter referred to as the City). This agreement will commence on the date of the signature by both parties and will continue in force until terminated by 30 days' written notice by either party. Purpose: The City of Corpus Christi has between 40 to 50 work -injured City employees at any one time in the City's Workers' Compensation system. The Texas Rehabilitation Commission works with many of these injured workers, although the injured workers have not usually been referred to the Commission until after claim settle- ment or after several months of injury. Because rehabilitation is much more effective for injured workers early on after injury and the City is interested in returning injured workers to the work force as soon as possible, this agreement has been developed to provide timely Vocational Reha- bilitation Services for injured City workers. In consideration of the mutual benefits to be derived from the parties hereto, the City and the Commission agree to the follow- ing terms and conditions: I. The Commission agrees to: (a) Schedule and coordinate diagnostic services for injured workers and to assess each injured worker for Vocational skills, limitations, and capabilities. (b) Provide diagnostic information to the City's Risk Manager on injured workers upon a waiver of confiden- tiality signed by the worker. (c) Assist in the payment of necessary on-the-job training, vocational training, and other types of formal or informal types of training as deemed necessary for returning the injured worker to employment. (d) Provide placement services to those injured workers who no longer can return to employment with the City. 101AT058 . AG?. -1- (e) Provide vocational services to include maintenance, fees, transportation, books and supplies, equipment, etc., as necessary and appropriate to injured workers, if and when these services are necessary for the worker to return to employment. (f) Assign appropriate staff to act as liaison with the City to receive referrals and provide vocational rehabilitation services. This staff member will coordinate vocational rehabilitation plans and services between the worker, City, attorneys, physicians, etc. (g) Provide vocational counseling and guidance to injured workers. II. The City shall be responsible for: (a) Payment of all necessary diagnostic procedures approved in writing by the City's Risk Manager to determine injured workers' physical and/or vocational limitations and capabilities. Diagnostic services may include one or more of the following: medical exams, vocational assessment, vocational education, psychological tes- ting, work hardening, back schools. (b) Providing diagnostic medical information to the Commis- sion upon written waiver of confidentiality. (c) Payment of necessary medical restoration expenses as approved by the Risk Manager. (d) Identification and development of possible on-the-job training sites within the City for qualified injured workers. (e) Payment of selective on-the-job and vocational training plans as approved in writing by the vocational rehabi- litation counselor and the Risk Manager. (f) Referral of injured workers to the Commission within one to three months of injury. (g) Providing assistance in reemployment of injured workers within the City if possible. (h) Cooperating with Commission Counselors in performing job site modification, as appropriate. 101AT058.AGR -2- Provided, however, that the City's Risk Manager is hereby expressly authorized by the City Manager to incur expenses as proscribed by the claims and expenditure authority granted by the City Council to the Risk Manager. This limitation shall not be applicable to the City Manager, and any amounts in excess of this limitation may be authorized by the City Manager as permitted by law. No action by the Risk Manager shall constitute an implied or express amend- ment of this agreement. Any amendment hereof shall be in writing and executed by the City Manager and the Commission. III. General Provisions: (a) The Texas Rehabilitation Commission is an agency of the State of Texas and agrees to all parts of this agree- ment only to the extent authorized by the laws of the State of Texas, and expressly does not waive any right, privilege, or immunity under such law. (b) The parties understand that all decisions relating to eligibility for and the provision of vocational reha- bilitation services are the responsibility of Texas Rehabilitation Commission employees and cannot be delegated. (c) The parties agree that all client information is provided under the assurance that it will be properly safeguarded, used only for the purpose for which it was provided, and not released to unauthorized persons. (d) The parties agree that they do not discriminate in the provision of services or benefits on the basis of race, color, religion, sex, national origin, age, or handi- cap. IV.
