CLOSING AND ABANDONING A 3.6 -FOOT WIDE BY 150 -FOOT LONG
PORTION OF CUIPER STREET RIGHT-OF-WAY ADJACENT TO LOT 20R,
BLOCK 15, CUIPER ADDITION, PROVIDING THE APPLICANT PAY
$2,450 AS THE FAIR MARKET VALUE FOR THE CLOSED RIGHT-OF-WAY
AND REPLAT THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN
EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of a 3.6 -foot wide by 150 -foot long portion of Cuiper Street
right-of-way adjacent to Lot 20R, Block 15, Cuiper Addition, was given by
publication and mailed to the last known addresses of the owners of property
abutting the public way and within 450 feet of the area proposed to be closed,
and thereafter, pursuant to said notice, public hearing was held during a
meeting of the City Council of the City of Corpus Christi on June 21, 1988, in
accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portion of right-of-way, proposed to be closed, is not needed now,
nor will it be within the foreseeable future needed as a public right-of-way,
and that the same should revert to the abutting property owners, subject to
certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned 3.6 -foot wide by
150 -foot long portion of Cuiper Street right-of-way adjacent to Lot 20R,
Block 15, Cuiper Addition, described by the metes and bounds which are attached
hereto and made a part hereof, marked Exhibit A, providing that applicant pay
$2,450 as the fair market value for the closed right-of-way and replat the
property within 180 days.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for the
efficient and effective administration of City affairs, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances at three regular meetings so that this
ordinance is passed a d shall take effect upon f'rst reading as an emergency

Addition;
THENCE South 28°10'00" West 52.06' to the point of beginning being the
northeast point of the tract and a point of curvature of a circular curve;
THENCE along the arc of said curve whose central angle is 90°10'00", radius
15.0', tangent 15.04' a distance of 23.60' to the point of tangency;
THENCE North 61°40'00" West along the south lot line of Lot 20R a distance of
135' to a point for the northwest corner of this tract;
THENCE South 28°10'00" West 3.6' to a point for the southwest point of this
tract;
THENCE South 61°40'00" East 150.04' to a point for the southeast point of the
tract;
THENCE North 28°10'00" East 18.64' to the POINT OF BEGINNING, and containing
0.013 acres more or less.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
