HomeMy WebLinkAbout020370 ORD - 07/05/1988AN ORDINANCE AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED FOR THE PRIVATELY -OWNED PARKING AREAS SHOWN ON THE PLAT OF CUIPER ADDITION TO CLARIFY OWNERSHIP; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a Quit Claim Deed for the privately -owned parking areas shown on the plat of Cuiper Addition to clarify ownership, all as more fully set forth in the Quit Claim Deed, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall to e effect upon f,r,st reading as an emergency measure this the day of , 19 ATTEST: /1/11t4( -^a N47,_ City Secretary APPROVED:5 7 DAY OF City Attorney 206HG146.ord %c MAJI'OR THE CITY OF CORPUS CHRISTI, TEXAS zo370 MICROFILMED QUIT CLAIM DEED THE STATE OF TEXAS § COUNTY OF NUECES § WHEREAS, by plat of record in Volume 10, Page 37, of the Map and Plat Records of Nueces County, Texas, there was shown a Block 15 of Cuiper Addition, which block consipted of a "public parking area" abutting Ayers Street seventy feet (70') in depth, and Lots 1 thru 20 of said Block 15 extending from said "public parking area" to the alley, and WHEREAS, designation of this area as "public parking area" implies that the public has some right or interest in this area and execution of a Quit Claim Deed by the City to Ray E. Peterson and wife, Christiana Peterson, will clarify the City's rights and interest in the area, NOW, THEREFORE, the City of Corpus Christi, Texas, a municipal corporation, duly incorporated under and by virtue of the laws of the State of Texas of Nueces County, Texas, acting by and through its City Manager, duly authorized by the City Council, for and in consideration of One Dollar ($1.00) to it in hand paid by Ray E. Peterson and wife Christiana Peterson, the receipt of which is hereby acknowledged, has RELEASED, RELINQUISHED AND QUITCLAIMED, and by these presents does RELEASE, RELINQUISH AND FOREVER QUITCLAIM unto the said Ray E. Peterson and wife, Christiana Peterson, all its right, title and interest to all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas; and being more particularly described as follows: Tract designated as "Public Parking Area" adjacent to Lots 1 thru 20, Block 15, Cuiper Addition, an addition to the City of Corpus Christi, Nueces County, Texas, according to map or plat recorded in Volume 10, Page 37, Map Records, Nueces County, Texas, and subsequent street dedication as described in Volume 1385, Pages 758-763, Nueces County Deed Records, being further described as follows: BEGINNING at a point being the original north most corner of said Lot 1, being also N50°36'50"E, 71.36 feet from the intersection of the original southerly right-of-way of Horne Road and the easterly right-of-way of 100 foot wide Ayers Street, THENCE S28°10'W, 6.12 feet to the Point of Beginning of this tract, THENCE S28°10'W, 1050.98 feet to a point for the south most corner of this tract, being also a point on the northerly right-of-way of 60 foot wide Cuiper Street, THENCE N61°40'W, along said Cuiper Street right-of-way 70.00 feet to a point lying on said easterly right-of-way of Ayers Street, THENCE N28°10'E along said Ayers Street right-of-way 1013.51 feet to a point of curvature of a circular curve to the right; Quit Claim Deed Ray & Christiana Peterson Page 1 of 2_ THENCE along the arc of said curve whose central angle radius = 42.10 feet, tangent = 51.15 feet, a distance to this point of tangency, THENCE S50°36'50"E, 20.21 feet to the Point of containing 1.69 acres, more or less. = 101°13'10", of 74.20 feet Beginning and With all and singular its right, title, interest, estate, claim and demand in and to the hereditaments and appurtenances thereto in anywise belonging TO HAVE AND TO HOLD, the above released rights, titles, interests, claims and demands in and to said tract of land unto the said Ray E.
