HomeMy WebLinkAbout020373 RES - 07/12/1988A RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO A PARCEL OF LAND FOR THE SAN CARLOS AREA PARK PROJECT AND TO ACQUIRE SAID PARCEL FROM THE OWNERS, MR. AND MRS. GARNETT T. BROOKS. WHEREAS, it is necessary to acquire, for and on behalf of the City, a certain parcel of land, more fully described hereinafter; and WHEREAS, the San Carlos Area Park Project requires the acquisition of fee simple title in and to the said parcel and to acquire said parcel from the owners, Mr. and Mrs. Garnett T. Brooks; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owners and claimants as to the price and value of said parcel and damages for the taking thereof by the City; it is, therefore, determined by the City Council that it is necessary that the said parcel be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the San Carlos Area Park Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcel of land, excluding mineral interest, said parcel being described by metes and bounds as follows: Being a 2.50 acre tract of land out of Gregorio Farias Grant, Nueces County, Texas, within Tract 39, Gregorio Farias Grant, as shown on Tax Assessors Map No. 156, also being that portion of land once platted as Lots 1-5, 28-33, Block 6, and portions of the following lots: Lots 11, 12, Block 5, Lots 25-27, Block 7, Lots 15, 16, Block 8, Rio Vista Subdivision, in Volume 21, Page 86, Map Records, Nueces County, Texas, and having been reverted to acreage by Nueces County Commissioners Court, Nueces County, Texas, and being further described as follows: Beginning at a point being North 78° 46" West, 165.00 feet from the Southmost corner of Lot 1, Block 1, in the portion of said Rio Vista Subdivision not reverted to acreage; Thence North 78° 46" West, 330.00 feet to a point; 206RP115.res 20373 MICROhLIED. Thence North 11° 14" East, 330.00 feet to a point for the North corner of this tract; Thence South 78° 46" East, 330.00 feet to a point on the Westerly right-of-way of 50 foot wide River Lane; Thence South 11° 14" East along said right-of-way, 330.00 feet to a point of beginning. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes.
