BEAUREGARD, ET UX BY GRANTING A SPECIAL COUNCIL PERMIT FOR A MINIATURE GOLF COURSE WITH SIX CONDITIONS ON LOTS 11 THROUGH 13, BLOCK 71, SECTION 3, PADRE ISLAND - CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Robert L. Beauregard, et ux, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, July 12, 1988, during a meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted on Lots 11 through 13, Block 71, Section 3, Padre Island - Corpus Christi, situated in the City of Corpus Christi, Nueces County, Texas, for a miniature golf course with the following six conditions and according to the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit A, and subject to all other considerations of "B -2A" Barrier Island Business District: 1. That an 8' high stucco fence be constructed along the south property line adjacent to the "R-2" zoned area, to be maintained by the owner; 2. That a 10' wide landscape strip be established north of and adjacent to the 8' high stucco fence, as required above, such landscape strip to include 1-1/2" caliper Australian Pine sp. "Cunninghamia equestifolia" trees planted 10' on center and irrigated by a strip irrigation system; 3. That lighting be directed downward and away from the adjacent residentially zoned area, but shall not preclude decorative lighting adequately shielded from the residential area; 206RP138.ord 20379 MICROFILMED 4. That sound speakers be limited to a height of 6' and be directed away from the adjacent residentially zoned area; 5. That provision of 32 parking spaces be available on or off the subject property, as per City regulations; and 6. All of the above, in accordance with the attached site plan. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
