AMENDING THE ZONING ORDINANCE UPON APPLICATION OF THE CLOWER
COMPANY BY GRANTING A SPECIAL COUNCIL PERMIT FOR ONE 121
SQUARE FOOT, 40' TALL, FREESTANDING SIGN TO BE LOCATED
BEHIND THE 20' SETBACK OF THE SOUTH STAPLES STREET PROPERTY
LINE AND ONE 70 SQUARE FOOT, 30' TALL, FREESTANDING SIGN TO
BE LOCATED BEHIND THE 20' SETBACK OF THE WEBER ROAD PROPERTY
LINE, ON A PORTION OF LOTS B AND C, BLOCK 1, MARKINS PLACE;
AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of The Clower Company,
for amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, July 12, 1988, during a meeting
of the City Council in the Council Chamber at City Hall in the City of Corpus
Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on a 0.949 acre
tract out of Lots B and C, Block 1, Markins Place, situated in the City of
Corpus Christi, Nueces County, Texas, and further described by metes and bounds
attached hereto as Exhibit A, for one (1) 121 square foot, 40' tall,
freestanding sign to be located behind the 20' setback of the South Staples
Street property line and one (1) 70 square foot, 30' tall, freestanding sign to
be located behind the 20' setback of the Weber Road property line as indicated
on the approved site plan and on the sign elevation drawings, copy of which are
attached hereto and made a part hereof, marked Exhibits B and C respectively,
and subject to all other considerations of "B-1" Neighborhood Business District.
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.

SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
at three regular meetings so that this ordinance is passed and sh 1 tae effect

DESCRIPTION OF A 0.949 -ACRE TRACT
OF LAND OUT OF THE REPLAT OF LOT 25, BLOCK 1,
MARKINS PLACE SUBDIVISION, NUECES COUNTY, TEXAS
Being a tract of land containing 0.949 -acre (41,355 square feet) out
of Lots "B" and "C" of the Replat of Lot 25, Block 1, Marking Place
Subdivision, as recorded by map in Volume 17, Page 55 in the Nueces
County Map Records, Nueces County, Texas. Said 0.949 -acre tract being
more particularly described by metes and bounds as'follows:
BEGINNING at a 5/8 -inch iron rod set in the southwest right-of-way
line of South Staples Street (100 feet wide) for a southeast corner of
Lot 1, Block 1 of•Markins Place Subdivision as recorded in Volume 15,
Page 53; Nueces County Map Records also being the north corner of said
tract herein described;
Thence South 31 deg. 00 min. 00 sec. East with the southwest
right-of-way line of said South Staples Street and with a northeast line
of Lot "C" of the Said Replat of Lot 25, at a distance of 23.25 feet pass.
the southeast line of a 20 -foot wide alley as abandoned by Ordinance
Number 5717 (March 23, 1960),City of Corpus Christi, Texas, and
continuing for a total distance of 185.00 feet to a 5/8 -inch iron rod set
for an east corner of said tract herein described;
THENCE South 28 deg. 20 min. 00 sec. West with a southeast line of
said tract herein described, a distance of 197.64 feet to a 5/8 -inch iron
rod set for a interior corner of said tract herein described;
THENCE South 31 deg. 00 min. 00. sec. East with a southeast line of
said tract herein described at a distance of 20.17 feet pass the
southeast line of Lot "C" and the northwest line of Lot "B" of the said
Replat of Lot 25 and continuing for a total distance of 145.17 feet to a
5/8 -inch iron rod set in the northwest right-of-way line of Weber Road
(80 feet wide) for a southeast corner of said tract herein described;
THENCE South 28 deg. 20 min. 00 sec. West with the northwest
right-of-way line of said Weber Road and with the southeast line of line
of said Lot "B", at a distance of 11.63 feet pass the northeast line said
20 -foot wide abandoned alley and continuing for a total distance of 34.88
feet to a 5/8 -inch iron rod set at a northeast corner of said Markins
Place Subdivision for the southwest corner of said tract herein
described;
THENCE North 31 deg. 00 min. 00 sec. West.with the northeast line of
said Marking Place Subdivision, with the southwest line of said Replat of
Lot 25 and with the southwest line of said abandoned 20 -foot wide alley,
a distance of 330.17 feet to a 5/8 -inch iron rod set for the northwest
corner of said tract herein described;
THENCE North 28 deg. 20 min. 00 sec. East with a southeast line of
said Markins Place Subdivision, with the northwest line of said Replat of
Lot 25 and with the northwest line of said abandoned 20 -foot wide alley,
a distance of 232.52 feet to the POINT OF BEGINNING and containing
0.949 -acre (41,355 square feet) of land.
