HomeMy WebLinkAbout020426 ORD - 08/16/1988AN ORDINANCE AUTHORIZING THE SALE OF LOTS 5, 6, 7, 8, 9, 10, BLOCK 4, BRENNAN ADDITION LOCATED IN THE 1900 BLOCK OF LIPAN STREET TO MARTIN A. VALDEZ FOR $17,250; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a special warranty deed with vendor's lien to effectuate the sale of Lots 5, 6, 7, 8, 9, 10, Block 4, Brennan Addition, located in the 1900 block of Lipan Street, to Martin A. Valdez, all as more fully set forth in the special warranty deed, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need of executing the abovementioned special warranty deed at the earliest practicable date, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall to effects upon first readingas an emergency measure this the 16441 day of e g ATTEST: City Secretary APPROVED: /5 DAY OF HAL GEORGE, CITY ATTORNEY if B .& Assistant Cit Attorney 206AG161.ord MYOR , 198e THE CITY OF CORPUS CHRISTI, TEXAS 20426 MCROFII.MED City of Corpus Christi, Texas Property and Land Acquisition Division SPECIAL WARRANTY DEED WITH VENDOR'S LIEN THE STATE OF TEXAS 1f KNOW ALL MY THESE PRESENTS: COUNTY OF NUECES t That I, Juan Garza, the duly appointed City Manager of the City of Corpus Christi, a municipal corporation of the County of Nueces, State of Texas, for and in consideration of the sum of Ten Dollars [$10.00] and other valuable consideration to the undersigned cash in hand paid by the Grantee herein named, the receipt of which is hereby acknowledged and the further consideration of the execution and delivery by Grantee of his one Real Estate Lien note of even date herewith in the principal sum of TWELVE THOUSAND NINE HUNDRED DOLLARS AND NO CENTS [$12,900.00] payable to the order of Grantor in monthly installments and bearing interest as therein provided, containing the usual clauses providing for acceleration of maturity and for attorney's fees, the payment of which note is secured by vendor's lien herein retained, and is additionally secured by a Deed of Trust of even date herewith to Jorge G. Garza, Trustee, have GRANTED, SOLD, and CONVEYED, and by these presents do GRANT, SELL, and CONVEY unto MARTIN A. VALDEZ of the County of NUECES, State of TEXAS, all of the following described real property in Nueces County, Texas, to -wit: All of Lots Five [5], Six [6], Seven [7], Eight [8], Nine [9], Ten [10], Block Four [4], Brennan Addition, an addition to the City of Corpus Christi, Texas as shown by the map or plat hereof, as recorded in Volume 299, Page 11 of the Map Records of Nueces County, Texas. "Special Warranty Deed with Vendor's Lien" 1900 block of Lipan St. [Valdez] Page 1 of 3 TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging unto the said Grantee, his heirs and assigns forever; and I do hereby bind myself, my successors and assigns to warrant and forever defend all and singular the said premises unto the said Grantee, his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through or under the City of Corpus Christi, but not otherwise. But it is expressly agreed that the Vendor's Lien, as well as the superior title in and to the above described premises, is retained against the above described property, premises and improvements until the above described note and all interest thereon is fully paid according to the face, tenor, effect and reading thereof, when this Deed shall become absolute.
