AUTHORIZING THE EXECUTION OF ALL DOCUMENTS NECESSARY FOR THE
ACQUISITION OF THE CENTRAL POWER AND LIGHT COMPANY BUILDING
AND LAND AT 120 NORTH CHAPARRAL AND THE MODIFICATION OF THE
CITY'S FRANCHISE FEE AGREEMENT WITH CENTRAL POWER AND LIGHT
COMPANY TO PROVIDE FOR MONTHLY RATHER THAN SEMI-ANNUAL
PAYMENT OF FRANCHISE FEES; AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute any and all
documents necessary for (a) the acquisition by the City of the real property
described in Exhibit A attached hereto, together with all improvements situated
thereon, being the Central Power and Light Company building at 120 North
Chaparral, for a purchase price of $1,400,000; and (b) the modification of the
franchise fee agreement between the City and Central Power and Light Company to
provide for monthly rather than semi-annual payment of franchise fees by Central
Power and Light Company beginning December 1, 1988, as consideration for the
City's execution of an Earnest Money Contract for acquisition of said property.
SECTION 2. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
execute the abovementioned documents at the earliest practicable date which is
necessary for the efficient and effective administration of the City's affairs,
such finding of an emergency is made and declared requiring suspension of the
Charter rule as to consideration and voting upon ordinances at three regular
meetings so that this ordinance is passed and shall take eff ct upon first

Beach Portion, and the "Arroyo Tract", also known as "Arroyo
Beach Lot", between Block 15 and Block 1 in Beach Portion, an
addition to the City of Corpus Christi, a plat of which is
recorded in Volume A, pages 2 and 3, Map Records of Nueces
County, Texas, being the same property conveyed to Central Power
and Light Company by the following conveyances, all of which are
recorded in the Deed Records of Nueces County, Texas:
1. From W. D. Nolte, et al, to Texas Central Power
Company, dated February 6, 1926, recorded in
Volume 161, pages 51-53;
2. From Gulf Coast Power Company to Central Power and
Light Company, dated June 1, 1926, recorded in
Volume 165, pages 611-613;
3. From Gulf Coast Power Company to Central Power and
Light Company, dated June 24, 1927, recorded in
Volume 172, paged 355-357;
4. From Central Power and Light Company, a Massachu-
setts corporation, to Central Power and Light
Company, a Texas corporation, dated January 15,
1946, recorded in Volume 320, pages 106-197, at
page 160;
5. From Raye Jean Simon, individually and as Indepen-
dent Executrix of the Estate of Joseph S. Simon,
deceased, to Central Power and Light Company,
dated June 30, 1970, recorded in Volume 1371,
pages 1008-1011; and
together with a revocable easement from the City of Corpus
Christi to Central Power and Light Company recorded in Volume
1795, pages 367-370 of the Deed Records of Nueces County, Texas,
all of which above referenced deeds are referred to for a more
full and accurate description thereof.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
