ALLEN, JANE PONTON, HOMESTEAD SAVINGS & LOAN ASSOCIATION, AND MAVERICK MARKETS, INC. FOR THE DEDICATION OF RIGHT-OF-WAY AND CONSTRUCTION OF THE AIRLINE ROAD/CIMARRON BOULEVARD INTERSECTION AS PROVIDED IN THE URBAN TRANSPORTATION PLAN. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with the owners of Lots 4 and 5, Block 8, Wooldridge Creek Unit 6 and Lots 1 and 2 of Block 1, Lots 1 and 2 of Block 2, and Lot 2 of Block 3 of the proposed Wooldridge Creek Unit 9 subdivision all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A." MICROFILMED AGREEMENT THE STATE OF TEXAS § COUNTY OF NUECES § This Agreement is entered into by and between the City of Corpus Christi, Texas, hereinafter referred to as "City" and Cimarron Venture I, Tim Clower, Partner, Owner of Wooldridge Creek Unit 6, Block 8, Lot 5; Homestead Savings and Loan Association, Owner of Wooldridge Creek, Unit 6, Block 8, Lot 4; R.C. Allen and Tim Clower, Owners of proposed Wooldridge Creek Unit 9, Block 1, Lot 2✓and Block 2, Lot 1; Maverick Markets, Inc., Owner of proposed Wooldridge Creek Unit 9, Block 1 Lot 2;' and Jane Ponton, Owner of proposed Wooldridge Creek Unit 9, Block 1, Lot 1 and Block 3, Lot 2, hereinafter referred to as "Owners". This agreement relates to the platting and development of these tracts and the construction/reconstruction of the Cimarron/Misty Meadow/Airline intersection as shown on Exhibit "A". WHEREAS, the City approved alignment and design for the Cimarron/Misty Meadow/Airline intersection will require the abandonment of portions of the right-of-way previously dedicated on Misty Meadow Road and Cimarron Boulevard and the dedication of new right-of-way for Misty Meadow Road, Cimarron Boulevard, and Airline Road to conform to the new alignment; and WHEREAS, in order to implement the realigned intersection as proposed by the City, a portion of the existing Misty Meadow street section must be removed and reconstructed and certain utilities must be relocated; and the City recognizes an obligation to pay the cost of the Misty Meadow realignment and utility relocations; and WHEREAS, the City desires to construct Misty Meadow Road and the portion of Cimarron Boulevard between Wooldridge Road and Airline Road in the proposed realignment as shown on Exhibit "A" in conjunction with the Airline Road Improvements, Phase I Project; and WHEREAS, the Owners would be required to construct Cimarron Boulevard between Wooldridge Road and Airline Road of the pavement section required under the Platting Ordinance in order to plat and develop their tracts; and WHEREAS, the Owners would also be required, under the Platting Ordinance, to construct water and sanitary sewer lines to provide service to each lot to be platted and to construct the twenty (20) inch diameter water grid main to connect the Wooldridge and Airline water systems to provide adequate pressure to the platted subdivision; and WHEREAS, the City desires to construct the portion of Cimarron Boulevard referenced above as a pavement section in excess of the Platting Ordinance requirements; and to construct the water and sewer services and twenty (20) inch water grid main referenced above in conjunction with the construction of Cimarron Boulevard for reasons of practicality; Agreement - Clower/Allen/Ponton Cimarron/Misty Meadow/Airline Page 1 of 5 ,)(-114-4. A NOW, THEREFORE, the City and Owners agree as follows: 1. The Owners agree to dedicate the necessary right-of-way for the construction of the Cimarron/Misty Meadow/Airline intersection in the new alignment as shown on Exhibit "A". If the dedications are to be made by separate instrument, the instruments shall be executed by the appropriate Owner within 30 days of City Council approval of this Agreement. If the \'\dedications are to be made by plat or replat, the necessary plats or replats 0 shall be submitted to the Planning Commission within 30 days of Council approval of this Agreement. *2. Upon receipt of all necessary dedications as outlined in Item 1, the City agrees to initiate street closure proceedings in accordance with the City ="= Code for the closure of the Cimarron Boulevard and Misty Meadow Road !� V'-`` rights-of-way shown on attached Exhibit "A". Ownership of Parcel 1, as shown c;',--(A-____on Exhibit "A", shall revert to Cimarron Venture I, Tim Clower, Partner, Owner of Lot 5, Block 8, Wooldridge Creek Unit 6. Ownership of Parcel 2, shall revert to Homestead Savings & Loan Association, Owner of Lot 4, Block 8, Wooldridge Creek Unit 6. Ownership of Parcel 3, shall revert to Jane Ponton, Owner of Lot 1, Block 1, Wooldridge Creek Unit 9. Ownership of Parcel 4 and Parcel 5 shall revert to R.C. Allen and Tim Clower, Owners of Lot 2, Block 1, Wooldridge Creek Unit 9. Said closure shall be subject to the replatting of the affected properties, the reconstruction of Misty Meadow Road and Cimarron Boulevard in the new alignment and the removal of the existing Misty Meadow Street section and relocation of utilities. At the time of said replatting, the Owners of Lot 2, Block 1, Wooldridge Creek Unit 9 shall transfer ownership of this lot or an adequate portion thereof to the Owners of Lot 5, Block 8 Wooldridge Creek Unit 6 to provide this lot with sufficient street frontage along Misty Meadow Road in accordance with the Platting Ordinance. 3. Upon receipt of the necessary dedications, the City agrees to release Cimarron Venture I and the J. L. Watson Company, Inc. from the terms and obligations of the previous paving agreement approved by the City Council on August 25, 1982, by Motion No. M82-0315 pertaining to the portion of Cimarron referred to as Parcel 1 on Exhibit "A". 4. The City shall finance and construct Misty Meadow Road in the new alignment to include the removal of the existing pavement section and relocation of existing water and gas utilities. The estimated cost of this construction is Sixty Two Thousand Five Hundred Dollars ($62,500.00) as shown on Exhibit "B". 5. The City shall also finance and construct the portion of Cimarron Boulevard between Wooldridge and Airline in the new alignment as the pavement section shown on Exhibit "B". The total estimated cost of this street construction is Two Hundred Ten Thousand Four Hundred Dollars ($210,400.00), as shown on Exhibit "B" attached hereto and made a part hereof. 6. The City shall assess the share of pavement costs in accordance with the current assessment policy to all abutting property owners along the new Cimarron Boulevard realignment except those portions of proposed Wooldridge Creek Unit 9, Block 1, Lot 1 and Block 3, Lot 2, for which access is being denied due to traffic considerations. The frontages of denied access are as outlined on Exhibit "A" and no assessments will be levied thereon. Agreement - Clower/Allen/Ponton Cimarron/Misty Meadow/Airline Paae 2 of 5 Assessment Liens and Notes will be filed upon completion and acceptance of the improvements by the City per current assessment procedures. Interest shall be charged on the assessments to these lots at the rate of eight percent (8%) to be calculated from the date of filing of the subdivision plat with the County Clerk to the time of payment of the assessments by the Owner. Assessments to the Owners as shown on Exhibit "B" are estimated as One Hundred Twelve Thousand Seven Hundred Dollars ($112,700.00). 7. The City shall finance and construct the portion of Airline Road between the City drainage right-of-way and Wooldridge Creek Unit 9, Block 3, Lot 2 as shown on Exhibit "A" as a 62 foot wide street section with curb, gutter and sidewalks. The City shall assess the share of the pavement costs in accordance with the current assessment policy to the abutting owner along Airline. Assessments to the Owner as shown on Exhibit "B" are estimated as Ten Thousand One Hundred Dollars ($10,100.00). 8. Actual assessments for the construction described in. Items 6 and 7 shall be based on the final assessment roll as adopted by the City Council based on actual construction costs. Construction shall not begin on these portions of Cimarron Boulevard or Airline Road until after the assessment public hearing has been held and a preliminary assessment roll is adopted by the City Council. 9. In addition to the pavement construction on Cimarron Boulevard outlined previously, the City shall also finance and construct the storm sewer system, the twenty (20) inch diameter water grid main along Cimarron to connect the Wooldridge and Airline systems and water and sanitary sewer lines as necessary to provide adequate water and sewer services to each lot of the Owners as defined herein. The estimated costs of this construction is as shown on Exhibit "B". 10. As shown on Exhibit "B", the estimated total cost to the Owners for the construction of Misty Meadow Road and Cimarron Boulevard in the proposed realignment is One Hundred Twelve Thousand Seven Hundred Dollars ($112,700.00) and the estimated total cost to the City is Two Hundred Fifty Two Thousand Nine Hundred Dollars ($252,900.00). These amounts do not include the Airline Road construction costs and assessments. Actual costs will be based on actual construction costs. Exhibit "B" also shows estimated costs the Owners would incur under the Platting Ordinance to provide a basis for comparison with this Agreement. 11. The Owners shall comply with all provisions of the Platting Ordinance except as herein noted. The Owners shall not be required to pay acreage fees on the portions of street right-of-way to be dedicated for the intersection realignment. 12. All conditions of this Agreement shall be substantially complied with within two years of the date of City Council action on this Agreement except as herein noted. If for any reason, that is beyond the control of either party, the conditions of this Agreement are not met within this time frame, then all conditions and terms of this Agreement shall be null and void unless extended by mutual agreement. The Owners further agree in compliance with the City of Corpus Christi Ordinance No 17112, to complete as part of this Agreement, the Disclosure of Ownership Interests form attached hereto and labeled Exhibit EXECUTED in duplicate, this day of , 1988.
