HomeMy WebLinkAbout020477 ORD - 09/27/1988AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH CIRCUS VARGAS CORPORATION FOR CIRCUS PERFORMANCES ON THE SITE OF THE OLD CITY HALL AND ADJACENT PARKING LOTS DURING OCTOBER 21-24, 1988; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute an agreement with Circus Vargas Corporation for circus performances on the site of the old city hall and adjacent parking lots during October 21-24, 1988, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need to execute the abovementioned agreement at the earliest practicable date, immediate action being necessary for the efficient and effective administration of the City's affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect u:on first eadin as an emergency measure this the Orl day of l , 19 g' . CIRCUS VARGAS CORPORATION 11559 SHERMAN WAY, SUITE 200 NORTH HOLLYWOOD, CALIFORNIA 91605 SITE AGREEMENT AGREEMENT madethis day of September 1988 between CIRCUS VARGAS CORPORATION (THE CIRCUS and CITY OF CORPUS CHRISTI CORPUS CHRISTI PARKS & RECREATION (CITY) LAND ADJACENT TO MEMORIAL COLISEUM (THE SITE). RECITALS A. THE CIRCUS is in the business of organizing, promoting, and presenting CIRCUS performances for the public (THE "PERFORMANCE or PERFORMANCES") . B. THE CITY owns or controls a location suitable for THE CIRCUS to conduct outdoor performances under THE CIRCUS tents, and is willing to make such location available to THE CIRCUS for such purpose on the terms and conditions set forth herein. AGREEMENT NOW, THEREFORE, the parties hereto agree as follows: 1. USE OF SITE: THE CITY hereby agrees to make available to THE CIRCUS the location (diagram attached) , for the Circus at your site for the purpose of organizing, promoting, and conducting performances thereon on the following dates: October 21 - 24, 1988. 2. ACCESS TO AND USE OF SITE: THE CIRCUS will be entitled to erect CIRCUS tents, assemble all CIRCUS props and equipment, shelter CIRCUS animals, and otherwise make use of the SITE as may be necessary in its judgment for the proper conduct of their Performances. For this purpose the CIRCUS shall be permitted to remain at the SITE for at least one day following the conclusion of the last scheduled performance between October 21 - 24, 1988. The CIRCUS shall have sole right to its concessions and novelties. 3. OBLIGATION OF THE CIRCUS: To provide a three-ring Circus complete with performers and animals. The CIRCUS shall pay a rental fee of $4,000.00 to the CITY. The CIRCUS shall NOT advertise that the CIRCUS will be performing at the SITE in Corpus Christi or any community within 150 miles PRIOR to October 10, 1988. In connection with its use of the SITE location, the CIRCUS shall promptly repair, clean-up and restore the SITE location. SITE location will be returned to the same condition as it was prior to its use by the CIRCUS. The CIRCUS shall provide eight (8) security persons at the SITE for crowd control. The CIRCUS shall be responsible for clean-up and will keep providing one 40 -yard dumpster for trash containment and waste disposal during the days of Circus performances. The CIRCUS will provide a $2,000.00 Clean Up Bond refundable when all clean up and repairs are completed and approved by the Superintendent of Parks. 1 Corpus Christi, Texas day of 198 F TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance or resolution, an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances or resolutions at three regular meetings; I/we, therefore, request that you suspend said Charter rule andp ass this ordinance or resolution finally on the date it is introduced, or at the present meeting of the City Council.
