HomeMy WebLinkAbout020490 ORD - 10/11/1988AN ORDINANCE AMENDING THE PERMIT FEE SCHEDULE BY ESTABLISHING AND INCREASING CERTAIN PERMIT AND ADMINISTRATIVE FEES ESTABLISHED BY THE BUILDING, ELECTRICAL, MECHANICAL AND PLUMBING CODES; THE ELECTRICAL LICENSING ORDINANCE; AND ESTABLISHING FILING FEE FOR THE ZONING BOARD OF ADJUSTMENT; EFFECTIVE NOVEMBER 1, 1988; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the permit fee schedule covering fees for permits and other services required by the Building, Electrical, Mechanical, and Plumbing Codes, and Electrical Licensing Ordinance of the City of Corpus Christi is hereby amended to hereafter be known as the "Permit Fee Schedule" and to read as follows: BUILDING, ELECTRICAL, MECHANICAL, AND PLUMBING CODES AND ELECTRICAL LICENSING ORDINANCE 1. Building Code Fees (A) Standardized Building Valuation: The valuation to be used in computing building permit fees shall be the total value of all construction work including plumbing, electrical, mechanical equipment, and other systems, including appurtenances and site improvements. The valuation of building, alteration, or structure used in computing building permit fees shall be based and at least equivalent to standardized building valuation data as published periodically by the Southern Building Code Congress International. The applicant for a building permit may appeal any determination of the Building Official to the Building Code Board of Appeals. Standardized building valuations shall be reviewed and updated on an annual basis so as to reflect the current trends in construction. Any revisions thereto are hereby adopted by reference and declared to be a part of this ordinance. (B) Processing and Plan Review Fee: A processing and Plan Review Fee shall be paid in addition to the regular permit fee as provided for in the schedule below. Said fees shall be paid for each application processed and reviewed for the 206RP133.ord 1 20490 MICROFILMED purposes of obtaining a building permit as required by the City of Corpus Christi Building Code. Residential $9.00 per each residential (One & Two Family) plan review Commercial fee as per schedule based on valuation $ 0 - $ 20,000 $30.00 20,001 - 110,000 40.00 110,001 - or greater 50.00 (C) Building Permit Fees: A Building Permit Fee shall be paid as follows: (1) For all construction except as otherwise provided for in paragraph (2) and (3) below: (a) Where the valuation does not exceed $2,000.00, a minimum fee of $20.00 shall be required except that for a sign, the minimum fee shall be $40.00 (b) For a valuation over $2,000.00, up to and including $20,000.00, the fee shall be $20.00. for the first two thousand plus $3.30 for each additional thousand or fraction thereof. (c) For a valuation over $20,000.00, up to and including $110,000.00, the fee shall be $79.40 for the first twenty thousand plus $2.20 for each additional thousand or fraction thereof. (d) For a valuation over $110,000.00, the fee shall be $277.40 for the first one hundred ten thousand plus $1.10 for each additional thousand or fraction thereof. (2) Residential Construction: The fee schedule for new construction of one and two family dwellings, apartments, townhouses, and condominiums shall be 7.0 cents per square foot of the building area for the first three thousand square feet of building area plus 3.5 cents per square foot for each additional square foot of building area. Building area shall include all rooms and spaces within the main structure, except for attached garages. 206RP133.ord 2 (3) Accessory Residential Construction: Accessory residential construction such as room additions, storage rooms, utility rooms, garages, carports, patio covers, decks, green houses, portable buildings, gazebos, and other similar uses shall have a minimum permit fee of $20.00 per structure under 300 square feet in area, and for all others the fee shall be 7.0 cents per square foot of the building area. (D) Moving of Building or Structure: For the moving of any building or structure, by a licensed house mover, the fee permit shall be $100.00, plus the cost of the applicable survey fee. (E) Demolition of Building or Structure: For the demolition of any building or structure, the fee shall be $20.00. (F) Mobile (HUD -Code Manufactured) Home Installation Fee: The fee for a building permit for the installation of a mobile (HUD -Code Manufactured) home for occupancy upon a lot shall be a $25.00 minimum fee; with final fee based on total valuation, including cost of Mobile (HUD -Code Manufactured) Home. (G) Certificate of Occupancy For Existing Buildings: When an application for a Certificate of Occupancy for an existing building is made, a processing and compliance investigation fee of $50.00 shall be paid at the time of application. (H) Duplicate Certificate of Occupancy: In the event that a Certificate of Occupancy is lost or destroyed a duplicate Certificate of Occupancy may be issued provided that a fee of $10.00 for processing is paid at the time of application for each such duplicate. (I) Appeal Filing Fee: The application fee for filing an appeal to the Building Code Board of Appeals shall be $200.00. (J) Housemovers License: The annual fee for a house movers license shall be $100.00. (K) Minimum Fee: In the event the total fees, according to the foregoing schedules, are less than $20.00, then the minimum permit charge of 206RP 133 . o rd 3 $20.00 shall apply. If such total fees exceed the sum of $20.00, the greater amount shall be charged. 2. Electrical Code Fees (A) Electrical Permit Fees: Except as provided for New Residential Construction as provided below, the Electrical Permit Fee shall be: Construction Loop $3.20 *Circuits (including extensions and repairs) 3.20 Fixtures, Residential or Commercial Bldg. .30 Motors (each individual motor) 6.40 Services up to 100 Amperes 6.40 Services 101 to 200 Amperes 9.60 Services 201 to 400 Amperes 16.00 Services over 400 Amperes 32.00 Services each additional meter 3.20 Appliances (trash compactors, dishwasher, disposer, etc.) 3.20 Equipment -Heating (Heating and Commercial Cooking units and Hot Water Heaters) per 5 KW or fraction thereof 3.20 Equipment -Moving picture projector, X -Ray Machine or Elevator 16.00 Swimming Pool 25.00 Signs (per transformer) 3.20 General repairs (additional fee for work not included in any of the above) 20.00 *The term "Circuits" herein shall mean each main feeder, submain or branch circuit, for electrical services; and each fused or other type of automatic cutout protected wire of a final branch mul tiwi re circuit. Each such circuit shall be charged for and considered as a separate circuit within the terms of this section. (B) New Residential Construction: The fee schedule for new construction of one and two family dwellings, apartments, townhouses, and condominiums shall be 3.2 cents per square foot of the building area excluding garages. (C) .Minimum Fee: In the event the total fees, according to the foregoing schedules, are less than $20.00, then the minimum permit charge of $20.00 shall apply. If such total fees exceed the sum of $20.00, the greater amount shall be charged. 206RP133.ord 4 (D) Re -Out Inspection: The fee for re -out inspections requested for the purposes of obtaining a temporary and/or permanent electrical release shall be $25.00 when a Certificate of Occupancy has been filed concurrently. For all other re -out inspection requests without a Certificate of Occupancy application (i.e. declared use) a fee of $50.00 shall be paid. (E) Electrical Advisory Board: The application fee for processing a technical ruling, modification or request for approval through the Electrical Advisory Board shall be $200.00. (F) Fees for Examination or License: The fees covering examination for a license to qualify electricians of all classes shall be payable to the City at the Building Inspection Department as set out in Table I in subsection (3) of this section. The examination fee shall accompany the application for license. The license fee shall be paid to the Building Inspection Department before the issuance of a license and only after the person has been approved by the Examination Committee. (1) Annual renewal of licenses shall be accomplished by issuance of a license signed by the building official or his assistant issued upon payment each calendar year extending the validity of a license for that calendar year only. (2) Such renewals shall be in compliance with the regulations of the Electrical Licensing Ordinance. (3) Table I, Fees Classification a. Master Electrician b. Master Electrician -Sign c. Journeyman Electrician $20.00 Maintenance Electrician and Limited Journeyman Electrician (5) Licenses lost or destroyed during the year for which they are issued shall be reissued by the Chief Electrical Inspector, provided satisfactory evidence has been presented by the licensee of such loss or destruction, and provided the licensee pays to the city at the Chief Inspector's office the sum of $5.00 for each such duplicate license. (G) Electrical Examination Review: Requests to review an examination shall be scheduled with the Chief Electrical Inspector and a fee of $20.00 for the first hour, plus $10.00 for each additional hour or fraction thereof shall be charged. 3. Mechanical Code Fees (A) Mechanical Permit Fees: A Mechanical Permit Fee shall be paid as follows: (1) All Construction Except New Residential Construction. For all heating, ventilating, duct, air conditioning, and refrigeration systems except as provided by paragraph (2) for new residential construction: (a) $20.00 for the first $1,000.00 of valuation plus $2.20 for each additional $1,000.00 or fraction thereof for installation of non -existing heating, ventilating, duct, air conditioning and refrigeration system. (b) $20.00 fixed fee plus $2.20 per each $1,000.00 or fraction thereof in 206RP 133 . o rd 6 valuation for repairs, alterations, and additions to an existing system where cost is over $500.00. (2) New Residential Construction: The fee schedule for new construction of one and two family dwellings, apartments, townhouses, and condominiums shall be 3.2 cents per square foot of the building area excluding unconditioned garages. In buildings using self-contained air conditioning units less than two tons, the fee charged shall be that for the total cost of all units combined (see paragraph (A) above for rate). An additional fee for Boilers based on BTU input shall be paid as follows: 33,000 BTU (1BHP) to 330,000 (10 BHP) $22.00 Over 330,000 BTU. 49.50 (B) Temporary Operation Inspection Fee: For inspecting a heating, ventilating, refrigeration, or air conditioning system, a fee of $25.00 shall be paid by the contractor requesting such inspection. If the system is not approved for temporary operation on the first inspection, for each subsequent inspection for such purpose, the usual re -inspection fee will be charged. (C) Minimum Fee: In the event the total fees, according to the foregoing schedules, are less than $20.00, then the minimum permit charge of $20.00 shall apply. If such total fees exceed the sum of $20.00, the greater amount shall be charged. (D) Mechanical Advisory Committee: The application fee for filing an appeal to the decisions of the Building Official in regards to an interpretation, a technical ruling or modification of the Mechanical Code shall be $200.00. (E) Mechanical Contractor Records Registration: The registration fee for maintaining a current file for a licensed air conditioning contractor shall be $50.00, paid annually. 206RP 133. o rd 7 4. Plumbing Code Fees (A) Plumbing Permit Fees: Plumbing Permit Fees shall be payable, except as otherwise provided by paragraph B for New Residential Construction, as follows • • Each Water Service Each Water -Fed Icemaking Machine Each Plumbing Fixture Each Sink -Garbage Disposal Unit Lawn Sprinkler and Irrigation Systems, Per 1,000 sq. ft. of lot services Each Cooling Tower Each Pump Each Water Heater Each Gas Service Plus First Meter Loop, Per Meter Each Additional Meter Loop Each Gas Opening Each Building Sewer (Lateral) Each Building Sewer Extension to Other Buildings Each Grease Interceptor Each Private Sewage Disposal System Each Sand Trap Each Connection to Storm Sewer Each Roof Drain Each Manhole $3.30 3.30 3.30 3.30 3.30 9.90 3.30 3.30 3.30 3.30 3.30 13.20 9.90 16.50 33.00 16.50 16.50 6.60 16.50 (B) New Residential Construction: The fee schedule for new one and two family dwellings, apartments, townhouses, and condominiums shall be 3.2 cents per square foot of the building area excluding garages. (C) Minimum Fee: In the event the total fees per installation charged are less than $20.00, then the minimum permit charge of $20.00 shall apply. If such total fees exceed the sum of $20.00, the greater amount shall be charged. (D) Mechanical Advisory Committee: The application fee for filing an appeal to the decisions of the Building Official in regards to an interpretation, a technical ruling or modification of the Plumbing Code and/or obtaining a concurrence for an alternate material or method shall be $200.00. 206RP 133. o rd 8 5. General Provisions The following charges shall apply to all fees for which a permit is required by the Building, Electrical, Mechanical, and Plumbing Codes. (A) Failure to Obtain Permit Before Work on Job is Commenced: In the event that work for which a permit is required by said Codes is commenced prior to the issuance of the required permit, then the permit fee shall be doubled or $200.00, which ever is greater. The collection made is to help defray the additional cost of inspection work already done and issuing a permit under such circumstances and is not a penalty and is not preclusive of any remedy otherwise available to the City to enforce said Codes. (B) Investigation Fee: In the event that an inspection is made and the resultant discovery is that work for which a permit is required by said codes has been done but the required permit has not been obtained or issued, then the permit fee shall be doubled and a $200.00 investigation fee shall be added. (C) Re -Inspection Fee: When a re -inspection fee has been assessed as provided for by Code, said re -inspection fee shall be $18.00. (D) Moved Buildings: (General repairs) The fees for the rehabilitation of moved buildings or structures shall be the same as for new construction, plus the cost of a survey fee, when not included with the moving of building or structure fee. (E) Survey Fee: The fee for house moving surveys, surveys for status reports, building evaluations inspections, etc. shall be $125.00. This fee is applicable per construction discipline. (F) Fire Investigation: The fee for fire investigations performed to determine cause and/or condition of existing structures damaged by fire shall be $140.00. (G) Zoning Board of Adjustment: Any person, firm, or corporation appealing to the Board of Adjustment, necessitating the sending of notices and publication of notices to the newspaper shall be a $200.00 filing fee. 206RP 133 . o rd 9 (H) Permit Research: The fee for research to provide verification of legal descriptions, property dimensions, ownerships and/or other construction related data from permit files, etc. shall be $35.00 plus the cost of document reproduction. (I) Inspections Outside the City: (1) Fees for permits which require inspection outside the city limits shall be increased by $30.00 plus $1.00 per mile for projects within the city's extraterritorial jurisdiction. (J) (2) Permit fees for buildings or building components which are manufactured and inspected outside the city limits and beyond the city's extraterritorial jurisdiction prior to being moved into the city shall be increased as follows: For each in -plant inspection that is necessary, the permit fee shall be increased by $1.00 per mile plus $30.00 per each 200 miles or fraction thereof for the distance between the city and the manufacturing plant. Reduced Fees: Agencies of the federal, state, and county governments are exempt from the payment of fees in connection with the construction or repair of buildings used, owned, and located on property owned by said government agencies. Permit fees for public schools and other political subdivisions having ad valorem tax-exempt status, and for church sanctuaries and all other state constitutionally exempted ad valorem tax entities shall be 50 percent of the regular permit fee; provided that such reduced fee shall in no case be less than the minimum fee regularly charged. (K) Refunds: (1) A permit may be cancelled upon written application by the applicant at any time within six months of the date of the issuance of a building permit or within two months of the date of issuance of an electrical, mechanical, or plumbing permit. If no work has been done under such permit, 75 percent of the permit fee may be refunded when formally requested in writing by the applicant, provided that the City shall 206RP133.ord 10 retain a minimum of $20.00 to cover the cost of auditing the fee and preparing the request for refund. In all other instances regarding any fees collected by the Department for which a refund is requested due to contract default, lease cancellation, or other similar circumstances, the City shall retain a minimum of $20.00 to cover the cost of auditing the fees and preparing the request for refund. (2) In the event that the interpretation of the Building Official is not favorably upheld by the Building Code Board of Appeals, Electrical Advisory Board, or the Mechanical Advisory Committee; and provided an appeal is not forwarded to the City Council for final resolution or the City Council confirms the interpretation of such Board or Committee, then 100 percent of the application fee shall be refunded upon written request by the applicant. (L) Fees Rounded Off: Upon calculation of the total fee for any permit, said fee shall be rounded off to the nearest dollar before payment is made. SECTION 2. That Ordinance 18949, adopted July 30, 1985, is hereby repealed and that all fees herein contained and set forth by the Building, Electrical, Mechanical, and Plumbing Codes and Electrical Licensing Ordinance prior to this date are hereby superseded by this ordinance. The effective date of this ordinance shall be November 1, 1988. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4.
