EXPRESSING THE CITY'S SUPPORT OF THE TEXAS MUNICIPAL
LEAGUE'S EFFORTS TO CLARIFY THE STATE LAWS ON TRENCH SAFETY
ENACTED BY HOUSE BILLS 662 AND 665 DURING THE 1987
LEGISLATIVE SESSION.
WHEREAS, during the 1987 Legislative Session, two statutes were passed
which imposed additional responsibilities on municipalities with respect to the
design and utilization of trenches at construction sites; and
WHEREAS, the intent of the statutes was to reduce the number of
injuries and deaths resulting from improper or inadequate trench safety
provisions and to improve contractor compliance with applicable OSHA
regulations; and
WHEREAS, the statutes are unclear on the manner in which they are to
be implemented which has resulted in a variety of methods throughout the state;
and
WHEREAS, the Texas Municipal League, after consultation with the
Association of General Contractors, the Consulting Engineers Council of Texas,
the Texas Society of Professional Engineers, and the consulting firm of Espey,
Huston and Associates, has formulated recommendations on implementing the
statutes' requirements; and
WHEREAS, the TML's Legislative Policy Committee on Community
Development's subcommittee to study the interpretation problems has developed
recommendations to clarify the ambiguities of these laws;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Council hereby expresses its support of the
recommendations formulated by the subcommittee of TML's Legislative Policy
Committee on Community Development which would clarify the trench safety laws
enacted by House Bills 662 and 665 in the 1987 Legislative Session.
