HERNDON BY GRANTING A REVISED SPECIAL COUNCIL PERMIT FOR USED CAR SALES AND AUTO AIR CONDITIONING REPAIR (WITH ASSOCIATED ENGINE REPAIR) IN ACCORDANCE WITH THE SITE PLAN AND CONDITIONS, ON LOT 24 AND THE REMAINING PORTION OF LOT 25, BLOCK 6, KOOLSIDE ADDITION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Ben L. Herndon, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Tuesday, October 25, 1988, during a meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Revised Special Council Permit be granted on Lot 24 and the remaining portion of Lot 25, Block 6, Koolside Addition, further described by metes and bounds attached hereto as Exhibit A, situated in the City of Corpus Christi, Nueces County, Texas, for used car sales and auto air conditioning repair (with associated engine repair) located in accordance with the site plan, a copy of which is attached hereto and made a part hereof, marked Exhibit B and with with the conditions listed below, and subject to all other considerations of "B-1" Neighborhood Business District: 1. That landscaping be installed in accordance with the approved site plan; 2. That Zoning Ordinance parking requirements are met; 3. That no more than 20 cars be displayed for sale at any time; 4. That no automotive repair, body work, painting, or similar activity, other than auto air conditioning repair be permitted on the site; 207RP053.ord 20506 MICROFIIMED 5. That no additional curb cuts be added and the northernmost curb cut on Airline Road be removed and curbing reconstructed; 6. That signage conform to "B-1" regulations; 7. That the liquor sales cease prior to occupancy for the used car sales; and 8. That no other use in addition to used car sales and auto air conditioning repair be permitted on the site. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6.
