CLOSING AND ABANDONING PORTIONS OF TWO 15 -FOOT WIDE UTILITY
EASEMENTS AND ONE 20 -FOOT WIDE UTILITY/DRAINAGE EASEMENT IN
LOT 1, BLOCK 3, AND LOT 1, BLOCK 4, MOORE PLAZA, SUBJECT TO
THE PROVISIONS LISTED BELOW; AND DECLARING AN EMERGENCY.
WHEREAS, there exists portions of two 15 -foot wide utility easements
and one 20 -foot wide utility/drainage easement in Lot 1, Block 3, and Lot 1,
Block 4, Moore Plaza, recorded in Volume 53, Pages 106-109, Map Records of
Nueces County, Texas; and
WHEREAS, it has been determined that it is feasible and advantageous
to the City of Corpus Christi to abandon said easements, subject to the
provisions listed below:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That portions of two 15 -foot wide utility easements and
one 20 -foot wide utility/drainage easement in Lot 1, Block 3, and Lot 1,
Block 4, Moore Plaza, as recorded in Volume 53, Pages 106-109, further described
by metes and bounds attached hereto as Exhibits A and B, be and the same are
hereby closed for public use and every municipal purpose, subject to the
property being replatted at applicant's expense within 180 days of the passage
of this ordinance. The above described utility/drainage easements are hereby
abandoned to the owners of the abutting property in accordance with the laws of
the State of Texas, and for the service and interest of the inhabitants of the
City of Corpus Christi, Texas.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need to
close and abandon the abovementioned utility/drainage easements at the earliest
practicable date, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances at
three regular meetings so that this ordinance is passed and shall take effect

BEGINNING at the intersection of the Souter line of an existing 10.00 foot utility
easement with the Northeast line of an existing 15.00 foot utility easement for the North corner of
this easement to be abandoned, from which corner the North corner of Lot 1, Block 3 and the East
corner of Lot 2, Block 1 said Moore Plaza, bears North 28°57'35" East 10.00 feet, thence North
61°00'40" West 44.00 feet;
THENCE South 61°00'40" East 15.00 feet for a corner of this easement to be abandon;
THENCE South 26°57'35" West 165.43 feet to the beginning point of a circular curve to
the right whose radi us point bears South 60°07'38" West 114.00 feet and which has a central
angle of 124°31'25", a radi us of 114.00 feet, a tangent distance of 216.79 feet and an arc length of
247.76 feet;
THENCE, along said curve to the right, 247.76 feet for the South corner of this easement to
be abandoned;
THENCE North 28°57'35" East 17.61 feet to the beginning point of a circular curve to the
right whose radius point bears South 02°18'29" East 30.00 feet and which has a central angle of
02°17'18", a radi us of 30.00 feet, a tangent distance of 0.60 feet and an arc length of 1.20 feet;
THENCE, along said curve to the right 1.20 feet for a point of tangency and the point of
curvature of a circular curve to the left whose radius point hears North 00°0111" " West 99.00
feet and which hes a central angle of 116°00'57, a radius of 99.00 feet, a tangent distance of
158.48 feet and an arc length of 200.46 feet;
THENCE, along said curve to the left, 200.46 feet for a point of tangency and the point of
curvature de circular curve to the right whose radius point bears South 63°57'52" East 30.00
feet and which has a central angle of 54°59'43", a radius of 30.00 feet, a tangent distance of 15.62
