HomeMy WebLinkAbout020529 ORD - 11/22/1988AN ORDINANCE DESIGNATING THE JAVELINA COMPANY ZONE, AS DESCRIBED HEREIN, PURSUANT TO THE PROPERTY REDEVELOPMENT AND TAX ABATEMENT ACT; AND DECLARING AN EMERGENCY. WHEREAS, the Texas Property Redevelopment and Tax Abatement Act (the "Act") , Texas Tax Code, Chapter 312, as amended, authorizes the City Council of the City of Corpus Christi to designate a reinvestment zone for property tax abatement pursuant to said Act; and WHEREAS, it is the policy of the City of Corpus Christi to encourage the redevelopment of areas wherein the creation and retention of new jobs and investment will benefit the area economy, provide needed opportunities, strengthen the real estate market and generate tax revenues to support local services; and WHEREAS, an application for tax abatement was submitted by the Javelina Company, a Texas general partnership, requesting the designation of a reinvestment zone (the "Javelina Company Zone" or the "Zone") and the offering of tax abatement for a new Petrochemical Facility in accordance with the Guidelines and Criteria for Granting Tax Abatement adopted by the City of Corpus Christi; and WHEREAS, on Tuesday, November 15, 1988, notice of a public hearing on the designation of such Zone was published in a newspaper of general circulation in the City of Corpus Christi and was given by written notice to the presiding officer of the governing body of each taxing unit including property in the proposed Zone by certified mail, return receipt requested, in accordance with the Act; and WHEREAS, the City Council of the City of Corpus Christi conducted a public hearing on Tuesday, November 22, 1988, during the City Council meeting beginning at 2:00 p.m., at which all interested persons were entitled to speak and present evidence for or against the designation; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City of Corpus Christi finds and determines that the improvements sought under the application for tax abatement presented by Javelina Company, a Texas general partnership, are feasible and practical and would be a benefit to the land to be included in the Javelina Company Zone and to the City of Corpus Christi after a tax abatement agreement entered into and in accordance with the Act has expired. SECTION 2. The area to be designated as the Javelina Company Zone under the Act is reasonably likely as a result of the designation to contribute to the retention or expansion of primary employment and will attract major 207HG082.ord 20529 talat000.0 investment in the Zone that would be a benefit to the property and would contribute to the economic development of the City of Corpus Christi. SECTION 3. Designation of the property as the Javelina Company Zone pursuant to the Act and the use of the property proposed in the application for tax abatement complies with the comprehensive zoning ordinance adopted by the City of Corpus Christi, as amended. SECTION 4. The boundaries of the Javelina Company Zone are particularly described by the metes and bounds on Exhibit A attached hereto and incorporated herein by reference, and shall additionally include the pipeline easements, rights-of-way and corridors proposed to contain the pipelines more particularly described on Exhibit B attached hereto and incorporated herein by reference to extent said pipelines are within the concurrent boundaries of the City of Corpus Christi, the County of Nueces, and the Corpus Christi Independent School District. SECTION 5.
