HomeMy WebLinkAbout020533 RES - 11/29/1988A RESOLUTION AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY TO CONDEMN FEE TITLE TO PARCEL 1 FOR THE McKENZIE ROAD EXTENSION PROJECT AND TO ACQUIRE SAID PARCEL FROM THE OWNER, A. M. EWING. WHEREAS, it is necessary to acquire, for and on behalf of the City, a certain parcel of land, more fully described hereinafter; and WHEREAS, the Project requires the acquisition of fee simple title in and to the said parcel and acquire said parcel from the Owner, A. M. Ewing; and WHEREAS, the City of Corpus Christi is unable to arrive at an agreement with the said owner and claimant as to the price and value of said parcel and damages for the taking thereof by the City; it i s , therefore, determined by the City Council that it is necessary that the said parcel be acquired in fee title through the exercise of the City's power of eminent domain for said public purpose; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi does hereby order, direct and authorize that eminent domain proceedings be instituted for the purpose of acquiring the fee simple title of the following described land and premises, excluding mineral interest, for use by the City for the McKenzie Road Extension Project, and for other municipal purposes, within the city limits, and to condemn the fee title to the said parcel of land, excluding mineral interest, said parcel being described by metes and bounds as follows: Being a 0.209 acre tract of land out of the F. W. Shaeffer Survey No. 419, Abstract 570, Nueces County, Texas, and being more particularly described as follows: Beginning at a point being the northeast corner of Lot 20, Block 1, High Ridge Estates Subdivision, shown by plat in Volume 52, Pages 53, 54, Map Records, Nueces County, Texas, said point being also a point of the south right-of-way of 60 foot wide McKenzie Road; Thence North 14° 53' East 60.00 feet to a point for the northwest corner of this tract said point being also the southeast corner of Lot 1, Block 7, in the aforementioned High Ridge Estates Subdivision; Thence South 74° 54' 15" East 151.75 feet to a point for a northeast corner of this tract; 207RP086.res 20533 talCROMMED Thence South 15° 05' 45" West 60.00 feet to a point for a southwest corner of this tract, being also a point on the north lot line of Lot 5, Riverview Estates, shown by plat in Volume 34, Page 115, Map Records, Nueces County, Texas; Thence North 74° 54' 14" West 151.53 feet to the point of beginning, and containing approximately .209 acres. SECTION 2. The City Attorney is hereby authorized and directed to institute proceedings against the property and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the aforesaid project and for other municipal purposes.
