HomeMy WebLinkAbout020543 RES - 12/20/1988A RESOLUTION AUTHORIZING THE EXECUTION A GIFT AGREEMENT TO ACCEPT THE DONATION OF THE TWIN JALUFKA HOUSES, THE MEW HOUSE, AND THE CHRIS YUNG HOUSE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized to execute a gift agreement to accept the donation of the Twin Jalufka Houses, the Mew House, and the Chris Yung House, all as more fully set forth in the gift agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. ATTEST: City Secretary MAY/6R APPROVED: ktt- DAY OFe19W HAL GEORGE, CITY ATTORNEY By Assistant Cit Attorney 207AT095.res THE CITY OF CORPUS CHRISTI, TEXAS 20543 1C FILMED GIFT AGREEMENT This is an agreement whereby James Lawrence Wood, Trustee, and Catherine Elizabeth Searcy, Trustee, herein called "Donors", agree to donate to the City of Corpus Christi, herein called the "City", which agrees to accept as a gift, upon the terms and provisions hereof, the following described personal property, in its present condition, situated in Nueces County, Texas, to -wit: Two (2), Two-story frame houses to be known as the "Twin Jalufka Houses" formerly situated in Beach Addition, on Lot Twelve (12), Block Fifty -One (51) to the City of Corpus Christi and with a street address of 416 and 418 Palo Alto. One-story frame house to be known as the "Yung House" formerly situated in Beach Addition, on Lot Four (4), Block Fifty -One (51) to the City of Corpus Christi and with a street address of 1415 North Chaparral. One-story frame house to be known as the "Mew House" formerly situated in Beach Addition, on Lot Seven (7), Block Fifty -One (51) to the City of Corpus Christi and with a street address of 413 Fitzgerald Street. It is understood that this donation is granted upon the following conditions: 1. Each House is presently located on the Property belonging to the Donor and upon donation of the Houses, the City, at its own expense, will cause the Houses to be removed from the Property and relocated on land belonging to the City. 2. Upon effective date of delivery of this gift, the City will be wholly responsible for the Houses and contents and shall hold the Donor harmless from any liability whatsoever for any injury to persons or Property which may occur. It is agreed that the Houses and all other structures located on the Property will be removed within ninety (90) days from the effective date of the gift. 3. Upon the removal of the Houses and all other structures from the Property, the City agrees to cap off all utility lines to the Property. 4. In addition to the removal of the Houses, the City agrees to remove all other structures on the Property as well as to clear the Property of all building debris remaining after the removal of the Houses and other structures, including any tree limbs damaged or removed during the removal of the Houses and other structures. tx)1,3;6 By Donors' execution hereof, Donors acknowledge that they have read this agreement and understand that this agreement is not binding on the city until properly authorized by the City Council and executed by the City Manager of the City of Corpus Christi, Texas.
