AMENDING THE CITY CODE, CHAPTER 21, GARBAGE, TRASH AND OTHER
REFUSE, BY AMENDING SECTION 21-4, COLLECTION SERVICES OF THE
SANITATION DIVISION AVAILABLE UNLESS PROPERLY REFUSED;
AMENDING SECTION 21-19, SUBSECTION (B), CHARGES FOR SERVICES
TO BUSINESS AND COMMERCIAL ESTABLISHMENTS; ADDING A NEW
SECTION 21-19, SUBSECTION (C), WAIVER OF DISPOSAL FEES FOR
NON-COMMERCIAL CUSTOMERS; AND AMENDING SECTION 21-21.1,
CHARGES FOR DEMOLITION DEBRIS; PROVIDING FOR SEVERANCE; AND
PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code, Chapter 21, Garbage, Trash and Other
Refuse, is amended by amending Section 21-4, Collection services of the
sanitation division available, unless properly refused, to read as follows:
Sec. 21-4. Collection services of the sanitation division available,
unless properly refused.
The collection services of the sanitation division shall be available
to every residence, business or commercial establishment or other
occupied premises within the City of Corpus Christi. Except as
otherwise provided by this section, all owners, occupants or tenants
of residential properties shall be obligated to subscribe to the
City's collection services and shall pay the charges therefor. Any
owner, occupant, tenant or lessee of a business or commercial
establishment, or residential properties containing more than two
family dwellings, who does not desire the collection services of the
sanitation division provided for in this article shall not receive the
services and shall not be charged therefor, upon his notifying the
superintendent in writing that: (1) he does not want the services
rendered to his premises; (2) he intends to and will remove the
accumulated garbage and trash at his premises; (3) he will keep his
premises in such condition that he will not violate the applicable
provisions of this Code and other ordinances; and, (4) he will not,
after such notice, avail himself of or use directly or indirectly the
collection services of the sanitation division. If any owner,
occupant, tenant or lessee who files such notice fails to comply with
these conditions, then the superintendent shall make the collection
services of the sanitation division available and said owner occupant,
tenant or lessee shall pay the charges therefor.
For purposes of this section, all premises required by this ordinance
to subscribe to City collection services which are served by a private
garbage collection service as of the final reading of this ordinance
shall be exempt from the requirement to subscribe to City garbage

collection service until such time as the private collection service
shall cease for the particular property served. Nothing contained
herein shall prohibit the City from serving such premises at the
request of the residents. All residential properties hereby exempted
shall be required to subscribe to City garbage collection services
upon the termination of the private collection service.
The collection services of the sanitation division shall also be
available to premises outside the City if the owner of said premises
has contractually agreed to annex said premises to the City of Corpus
Christi.
SECTION 2. That the City Code, Chapter 21, Garbage, Trash and Other
Refuse, is amended by amending Section 21-19 (b), Charges for services to
business and commercial establishments, to read as follows:
Sec. 21-19. Same --To business and commercial establishments, etc.
(b) Charges for services to business and commercial establishments.
All other business and commercial institutions and other occupied
premises, except residences, shall be charged for the disposal
services of the sanitation division at a minimum rate of seventy-five
($0.75) cents per cubic yard or fraction thereof of trash and garbage
per week, based on the superintendent's estimate of volume of garbage
and trash.
SECTION 3. That the City Code, Chapter 21, Garbage, Trash and Other
Refuse, is amended by adding Section 21-19 (c) to read as fol ows:
Sec. 21-19. Same --To business and commercial establishments, etc.
(c) All operators of privately owned vehicles transporting garbage,
brush, demolition materials, etc. shall be charged the applicable
disposal fee unless the vehicle operator presents a city utility bill
or other document which certifies the operator as a paying customer of
the City's sanitation services.
SECTION 4. That the City Code, Chapter 21, Garbage, Trash and Other
Refuse, is amended by amending Section 21-21.1, Charges for demolition debris,
to read as follows:
Sec. 21-21.1. Charges for demolition debris.
The charge for disposal services of the sanitation division for debris
from demolition of buildings and structures shall be assessed on a

project basis at the rate of seventy-five ($0.75) cents per cubic
yard, based on the volume estimated by the Superintendent of
Sanitation. The building division shall provide the sanitation
division with a copy of the demolition permits issued to insure proper
billing.
SECTION 5. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 6. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
