AMENDING THE CITY CODE, CHAPTER 21, ARTICLE II, SOLID WASTE
PERMITS, SECTIONS 21-40, 21-41, AND 21-48, BY REPLACING
REFERENCE TO DIRECTOR OF INSPECTIONS AND OPERATIONS WITH
SANITATION SUPERINTENDENT OR HIS DESIGNEE; PROVIDING FOR
SEVERANCE; AND PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code, Chapter 21, Article II, Solid Waste
Permits, Sections 21-40, 21-41, and 21-48, be amended to read as follows:
Sec. 21-40. Solid waste permits required.
No person, except a duly authorized agent or employee of the city,
shall collect garbage or trash of any other person, or convey or
transport such garbage or trash on the streets, alleys or public
thoroughfares of the city, or dispose of such garbage and trash,
without a written solid waste permit granted and issued by the
Sanitation Superintendent or his designee.
Sec. 21-41. Application generally.
Any person desiring a solid waste permit for the collection, removal
and disposal of garbage and trash, as required in Section 21-40 of
this Code, shall make application for such solid waste permit to the
Sanitation Superintendent or his designee.
Sec. 21-48. Revocation and recission.
Solid waste permits may be revoked and rescinded by the Sanitation
Superintendent or his designee at any time, upon violation of the
conditions of the permit or violation of any provision of this chapter
or other ordinance of the city or any state law.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
