HomeMy WebLinkAbout020575 ORD - 01/24/1989AN ORDINANCE CLOSING AND ABANDONING A 10 -FOOT WIDE UTILITY EASEMENT IN LOTS 3, 4, AND 26 IN BLOCK 1 OF DEL MAR SUBDIVISION, SUBJECT TO THE PROPERTY BEING REPLATTED AT APPLICANT'S EXPENSE WITHIN 180 DAYS OF THE PASSAGE OF THIS ORDINANCE. WHEREAS, there exists a 10 -foot wide utility easement in Lots 3, 4, and 26 in Block 1 of the Del Mar Subdivision, recorded in Volume 4, Pages 8-10, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a l0 -foot wide utility easement in Lots 3, 4, and 26 in Block 1 of the Del Mar Subdivision, as recorded in Volume 4, Pages 8-10, Map Records, Nueces County, Texas, further described by metes and bounds, a substantial copy of which is attached hereto as Exhibit A, be and the same is hereby closed for public use and every municipal purpose, subject to payment of $405.30 for abandonment of a two-inch gas line, and subject to the property being replatted at applicant's expense within 180 days of the passage of this ordinance. The above described utility easement is hereby abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. DAY OF L)eu CITY OF CORPUS CHRISTI, TEXAS HAL GEORGE, CITY ATTORNEY „AA.A-ix-,L ,At; t ILZAJ4L.-411-- Assistant City Attorney' 612CC185.ord , 1988 205'75 MtCR0mMED STATE OF TEXAS COUNTY OF NUECES November 30, 1988 A strip of land ten feet in width designated as a Utility Reserve to be closed across the back of Lot 3 and Lot 4, Block 1, Del Mar, as shown on the Map thereof recorded in Volume 4, Pages 8--10 of the Map Records of Nueces County, Texas, save and except a portion five feet in length, more or less, to remain in the southwest corner of said Lot 3, and being more particularly described by metes and bounds as follows: COMMENCING at a 5/8 inch iron rod found at the northeast corner of Lot 4, and being the point of intersection of the southeast boundary of Southern Street and the northwest boundary of Ocean Drive; THENCE with the common boundary of Southern Street and Lot 4 South 58°54' West 139.96 feet to the easterly boundary of the Utility Reserve and the POINT OF'BEGINNING of the tract herein described; THENCE with the easterly boundary of said Utility Reserve South 35°53'49" East 115.40 feet to a point for the southeast corner of this closure; THENCE parallel to the southerly boundary of Lot 3 and at a perpendicular distance of 5.00 feet therefrom South 58°54' West 10.03 feet to a point on the rear boundary of Lot 3 for a corner of this closure, from which point the southwest corner of Lot 3 bears South 35°53'49" East 5.02 feet; THENCE with the rear boundary of Lot 3 and Lot 4 North 35°53'49" West 115.40 feet to a point for a corner of Lot 4 and a corner of this closure; THENCE with the common boundary of Lot 4 and Southern Street North 58°54' East 10.03 feet to the POINT OF BEGINNING, containing 1154 square feet, more or less.
