HomeMy WebLinkAbout020578 RES - 01/31/1989A RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE STATE HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION'S MINUTE ORDER NO. 88110 PERTAINING TO THE DESIGNATION OF PARK ROAD 53 AS A STATE HIGHWAY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby authorized the acceptance of the State Highway and Public Transportation Commission's Minute Order No. 88110 pertaining to the designation of Park Road 53 as a State Highway, all as more fully set forth in the Minute Order, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit A. ATTEST: /9>kYtoe-0,- ty Secretary APPROVED: )(0 DAY OF �y�,�,��, 19 �j(/ HAL GEORGE, CITY ATTORNEY 1z,01 fes, ssi stant Ci y Attorney 208JB002.res THE CITY OF CORPUS CHRISTI, TEXAS 20578 MICROFILMED STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION NUECES County MINUTE ORDER Page 1 of 3 Pages District No. CORPUS CHRISTI (16) WHEREAS, in NUECES COUNTY on PARK ROAD 53 from the end of State Highway 361 to Park Road 22, a distance of approximately 17.4 miles, local officials have requested this highway be upgraded to a four -lane divided highway; and WHEREAS, this highway is prone to inundation during storm tide surges and is the only route for evacuation off Mustang Island; and WHEREAS, it is desirable to acquire the right of way for this highway in order to protect the corridor; NOW, THEREFORE, IT IS ORDERED that the Engineer -Director is hereby directed to tender the following proposal to Nueces County and the Cities of Corpus Christi and Port Aransas: Provided Nueces County and the Cities of Corpus Christ and Port Aransas will: 1. Provide ten percent of the cost of right of way clear of obstructions and free of cost to the State with acquisition procedures to be in accordance with policies of the State Department of Highways and Public Transportation and with applicable Federal and State laws governing the acquisition policies for acquiring real property. 2. Provide ten percent of the cost of eligible utility adjustments as may be required in accordance with policies of the State Department of Highways and Public Transportation. Upon completion of the construction of this project, maintain that portion of the work which is its responsibility in accordance with Federal and State requirements, and agree to regulate traffic and prevent encroachment on the right of way, all in accordance with governing policies and regulations of the State Department of Highways and Public Transportation. The State Department of Highways and Public Transportation will: 1. Designate Park Road 53 a State Highway. 2. Provide ninety percent of the cost of right of way clear of obstructions with acquisition procedures to be in accordance with State Department of Highways and Public Transportation policies and with Federal and State laws governing the acquisition policies for acquiring real property. 3. Provide ninety percent of the cost of eligible utility adjustments as may be required in accordance with policies of the State Department of Highways and Public Transportation. 4. Provide relocation assistance as may be determined to be eligible under the Relocation Assistance Program. 5. Provide for construction when traffic warrants. STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION NUECES COUNTY MINUTE ORDER PAGE 3 OF 3 Pages District No. CORPUS CHRISTI (16) Upon acceptance of the provisions of this Order by Nueces County and the Cities of Corpus Christi and Port Aransas, IT IS FURTHER ORDERED that Park Road 53 from the end of State Highway 361 to Park Road 22 be and is hereby designated a STATE HIGHWAY; and the Engi neer- D i rect or is hereby authorized to proceed in the most feasible and economical manner with project development to include any necessary agreements, right of way acquisition, utility adjustments and relocation assistance at an estimated cost of $1,650,000. This authorization should not be considered as authorization for construction funding. However, after Nueces County and the Cities of Corpus Christi and Port Aransas have fulfilled their responsibilities, authorization of construction funding will be considered based on cost effectiveness, the availability of funds and statewide priorities. This Order shall become operative upon acceptance by Nueces County andthe Cities of Corpus Christi and Port Aransas; and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically canceled.
