CLOSING AND ABANDONING PORTIONS OF STREET RIGHT-OF-WAY MORE
FULLY DESCRIBED BELOW AND IN ACCORDANCE WITH THE PROVISIONS
SET FORTH HEREIN.
WHEREAS, notice of the time and place for holding a hearing concerning
the closing of theportions of street right-of-way listed below, was given by
publication and mailed to the last known addresses of the owners of property
abutting the public way and within 450 feet of the area proposed to be closed,
and thereafter, pursuant to said notice, public hearing was held during a
meeting of the City Council of the City of Corpus Christi on January 31, 1989,
in accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing that
the aforesaid portions of right-of-way, proposed to be closed, are not needed
now, nor will they be within the foreseeable future needed as public
rights-of-way, and thatthe same should revert to the abutting property owners,
subject to certain specified conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That there is hereby closed and abandoned the following
portions of street right-of-way as shown on Exhibit A:
1. A 30 foot wide right-of-way known as Cimarron Boulevard in Lots 2 and 3,
Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat in Volume 47,
Page 199, Map Records, Nueces County, Texas, and the remaining 10 foot wide
strip out of a 20 foot wide strip in the Flour Bluff and Encinal Farm and
Garden Tracts shown by plat in Volume A, Pages 41-42, Map Records, Nueces
County, Texas, as described by metes and bounds in attached Exhibit B; and
2. A 0.15 acre tract of land out of a portion of a 60 foot wide right-of-way
known as Misty Meadow and a 30 foot wide right-of-way known as Cimarron in
Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat
in Volume 47, Page 199, Map Records, Nueces County, Texas, as described by
metes and bounds on attached Exhibit C; and
3. A 13,819.31 square foot of land in Lot 16, Section 19, Flour Bluff and
Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map
Records, Nueces County, Texas, and also being a portion of a 60 foot wide
right-of-way known as Misty Meadow in Lots 2 and 3, Block 8, Wooldridge
Creek Unit 6 Subdivision, shown by plat in Volume 47, Page 199, Map
Records, Nueces County, Texas, as described by metes and bounds on attached
Exhibit D; and
4. A 0.021 acre tract of land in Lot 9, Section 12, Flour Bluff and Encinal
Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map
Records, Nueces County, Texas, and being adjacent to a portion of a 60 foot

wide right-of-way known as Misty Meadow in Lots 2 and 3, Block 8,
Wooldridge Creek Unit 6 Subdivision, shown in Volume 47, Page 199, of Map
Records, Nueces County, Texas, and being out of a 20 foot wide strip in the
Flour Bluff and Encinal Farm and Garden Tracts, shown in Volume A, Pages
41-42, Map Records, Nueces County, Texas, as described by metes and bounds
on attached Exhibit E; and
5. A 0.311 acre tract of land out of a portion of a 60 foot wide right-of-way
known a Misty Meadow in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6
Subdivision, shown by plat in Volume 47, Page 199, Map Records, Nueces
County, Texas, as described by metes and bounds on attached Exhibit F;
providing for rept atti ng of the affected properties, the reconstruction of Misty
Meadow Road and Cimarron Boulevard in the new alignment, the removal of the
existing Misty Meadow Road, and relocation of Utilities; and further providing
that ownership of Parcel 1 shall revert to Cimarron Venture I, Tim Clower,
Partner, Owner of Lot 5, Block 8, Wooldridge Creek Unit 6; ownership of Parcel 2
shall revert to Homestead Savings & Loan Association, owner of Lot 4, Block 8,
Wooldridge Creek Unit 6; ownership of Parcel 3 shall revert to Jane Ponton,
owner of Lot 1, Block 1, Wooldridge Creek Unit 9; ownership of Parcel 4 and
Parcel 5 shall revert to R. C. Allen and Tim Clower, owners of Lot 2, Block 1,
Wooldridge Creek Unit 9.

PARCEL 1
BEING a 0.54 acre tract of land out of a 30.00 foot wide right-of-way
known as Cimarron Boulevard as dedicated to the City of Corpus Christi
on a map of Lots 2, 3, Block 8, Wooldridge Creek Unit 6, a map of
which is recorded in Volume 47, Page 199 of Map Records, Nueces
County, Texas, and the remaining 10.00 foot wide strip which out of a
20.00 foot wide strip which was dedicated to ,the City of Corpus
Christi on a map of Flour Bluff and Encinal Farm and Garden Tracts, a
map of which is recorded in Volume A, Pages 41 through 42 of said Map
Records;
BEGINNING at a 5/8 inch iron rod set on the Southwest boundary of the
City of Corpus Christi 75.00 foot wide drainage right-of-way marking
the East corner of said Lot 3, Block 8 for the North corner of
Cimarron Boulevard and the North corner of this description;
THENCE South 61°00'40" East, along the Southwest line of said drainage
right-of-way, with the Northeast line of Cimarron Boulevard, 26.11
feet to its intersection point with the West boundary of Airline Road
for the upper East corner of this description.
THENCE South 02°27'45" West, along the West boundary line of Airline
Road, 31.08 feet for the lower East corner of this description;
THENCE leaving Airline Road, South 29°00'00" West, along the Southeast
line of the 10.00 foot wide strip as shown and dedicated in said
Volume A, Pages 1 through 43, same being the Southeast boundary of
Section 12, 562.16 feet to a point;
THENCE N 61°00'00" West 50.00 feet to a point;
THENCE Northeasterly along the arc of a circular curve to the left
whose central angle = 90°, radius = 10.00 feet, tangent length = 10.00
feet, a distance of 13.71 feet to a point of tangency;
THENCE North 29°00'00" East, with the Southeast line of said Lot 3,
Block 8, 579.97 feet to the POINT OF BEGINNING.

BEING a 0.15 acre tract of land out of a portion of a 60.00 foot wide

BEGINNING at a point being the Southmost corner of Lot 5, Block 8,
Wooldridge Creek Unit 6, shown by plat in Volume 53, Page 53, Map
Records, Nueces County, Texas, being a replat of a portion of said Lot
3, Block 8, said point being on the Northeast right-of-way of said
Misty Meadow Road;
THENCE South 29° West 50.26 feet to a point;
THENCE North 40°20'17" West 59.48 feet to the point of curvature of a
circular curve to the left whose radius point bears South 49°39'43"
West 455.15 feet and which has a central angle of 20°39'43", a radius
of 455.15 feet, a tangent distance of 82.97 feet and an arc length of
164.14 feet;
THENCE with said curve to the left, 164.14 feet to a point on the
Northeast boundary of Misty Meadow Road for the point of tangency and
the upper West corner of this tract, from which corner the East corner
of Wooldridge Creek Unit 7, a map of which is recorded in Volume 46,
Page 112, said Map Records bears South 29°00'00" West 60.00 feet,
THENCE South 61°00'00" East, along Northeast boundary line of Misty
Meadow Road, 266.25 feet to the POINT OF BEGINNING.

BEING a 13,819.31 square foot tract of land out of Lot 16, Section 19,
Flour Bluff and Encinal Farm and Garden Tracts, a map of which is
recorded in Volume A, Pages 41 through 43, Map Records of Nueces
County, Texas and also being a portion of a 60.00 foot wide
right-of-way known as Misty Meadow Road as dedicated to the City of
Corpus Christi on a map of Lots 2, 3, Block 8, Wooldridge Creek Unit
6, a map of which is recorded in Volume 47, Page 199 of said Map
Records.
BEGINNING at the point of intersection of the cInterline of a 40.00
foot wide county road (Cimarron Drive) , same being the common line
between Lot 16, Section 19 and Lot 9, Section 12 of said Flour Bluff
and Encinal Farm and Garden Tracts, with the West boundary line of
Airline Road (60.00 feet wide) for the North corner of this tract,
from which corner the East corner of Lot 3, Block 8, said Wooldridge
Creek Unit 6 bears North 02°27'45" East 31.08 feet;
THENCE North 61°00'41" West 26.11 feet;
THENCE South 02°27'45" West, along the West boundary of Airline Road,
parallel to its centerline and 30.00 feet distant therefrom, measured
at right angles thereto, 44.77 feet to the East corner of this tract;
THENCE South 29°00'00" West, parallel to the centerline of said 40.00
foot wide county road (Cimarron Drive) and 20.00 feet distant

THENCE with said curve to the left, continuing along said Northeast

known as Misty Meadow as dedicated to the City of Corpus Christi on a

recorded in Volume 47, Page 199 of said Map Records and being out of a
20.00 foot wide strip which was dedicated to the City of Corpus
Christi on a map of Flour Bluff and Encinal Farm and Garden Tracts, a
map of which is recorded in Volume A, Pages 41 through 42 of said Map
Records;
BEGINNING at a point being North 29° East, 587.85 feet from the
Southmost corner of said Lot 9, Section 12;
THENCE South 29° West 34.67 feet to a point being the beginning of a
circular curve to the left whose radius point bears South 34°54'25"
East 392.46 feet and which has a central angle of 02°28'33", a radius
of 392.46 feet, a tangent distance of 8.48 feet and an arc length of
16.96 feet;
THENCE along said curve to the left to the point of tangency and the
point of curvature of a circular curve to the right whose radius point
bears North 37°22'58" West 10.00 feet and which has a central angle of
87°02'41", a radius of 10.00 feet, a tangent distance of 9.50 feet and
an arc length of 15.19 feet;
THENCE with said curve to the right, 15.19 feet to the point of
tangency;
THENCE North 40°20'17" West 0.19 feet to a corner of this tract;

Records, Nueces County, Texas, being a replat out of a portion of said
Lot 3, Block 8, said point being on the Northeast right-of-way of said
Misty Meadow Road;
THENCE South 61° West along said right-of-way 219.08 feet to a point;
THENCE South 29° West, 70.00 feet to a point for the Southmost corner
of this tract;
