HomeMy WebLinkAbout020601 ORD - 02/21/1989AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF STREET RIGHT-OF-WAY MORE FULLY DESCRIBED BELOW AND IN ACCORDANCE WITH THE PROVISIONS SET FORTH HEREIN. WHEREAS, notice of the time and place for holding a hearing concerning the closing of theportions of street right-of-way listed below, was given by publication and mailed to the last known addresses of the owners of property abutting the public way and within 450 feet of the area proposed to be closed, and thereafter, pursuant to said notice, public hearing was held during a meeting of the City Council of the City of Corpus Christi on January 31, 1989, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the aforesaid portions of right-of-way, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public rights-of-way, and thatthe same should revert to the abutting property owners, subject to certain specified conditions: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby closed and abandoned the following portions of street right-of-way as shown on Exhibit A: 1. A 30 foot wide right-of-way known as Cimarron Boulevard in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat in Volume 47, Page 199, Map Records, Nueces County, Texas, and the remaining 10 foot wide strip out of a 20 foot wide strip in the Flour Bluff and Encinal Farm and Garden Tracts shown by plat in Volume A, Pages 41-42, Map Records, Nueces County, Texas, as described by metes and bounds in attached Exhibit B; and 2. A 0.15 acre tract of land out of a portion of a 60 foot wide right-of-way known as Misty Meadow and a 30 foot wide right-of-way known as Cimarron in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat in Volume 47, Page 199, Map Records, Nueces County, Texas, as described by metes and bounds on attached Exhibit C; and 3. A 13,819.31 square foot of land in Lot 16, Section 19, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map Records, Nueces County, Texas, and also being a portion of a 60 foot wide right-of-way known as Misty Meadow in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat in Volume 47, Page 199, Map Records, Nueces County, Texas, as described by metes and bounds on attached Exhibit D; and 4. A 0.021 acre tract of land in Lot 9, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map Records, Nueces County, Texas, and being adjacent to a portion of a 60 foot 208JB005.ord 20601 MICROFILMED wide right-of-way known as Misty Meadow in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown in Volume 47, Page 199, of Map Records, Nueces County, Texas, and being out of a 20 foot wide strip in the Flour Bluff and Encinal Farm and Garden Tracts, shown in Volume A, Pages 41-42, Map Records, Nueces County, Texas, as described by metes and bounds on attached Exhibit E; and 5. A 0.311 acre tract of land out of a portion of a 60 foot wide right-of-way known a Misty Meadow in Lots 2 and 3, Block 8, Wooldridge Creek Unit 6 Subdivision, shown by plat in Volume 47, Page 199, Map Records, Nueces County, Texas, as described by metes and bounds on attached Exhibit F; providing for rept atti ng of the affected properties, the reconstruction of Misty Meadow Road and Cimarron Boulevard in the new alignment, the removal of the existing Misty Meadow Road, and relocation of Utilities; and further providing that ownership of Parcel 1 shall revert to Cimarron Venture I, Tim Clower, Partner, Owner of Lot 5, Block 8, Wooldridge Creek Unit 6; ownership of Parcel 2 shall revert to Homestead Savings & Loan Association, owner of Lot 4, Block 8, Wooldridge Creek Unit 6; ownership of Parcel 3 shall revert to Jane Ponton, owner of Lot 1, Block 1, Wooldridge Creek Unit 9; ownership of Parcel 4 and Parcel 5 shall revert to R. THENCE South 02°27'45" West, along the West boundary line of Airline Road, 31.08 feet for the lower East corner of this description; THENCE leaving Airline Road, South 29°00'00" West, along the Southeast line of the 10.00 foot wide strip as shown and dedicated in said Volume A, Pages 1 through 43, same being the Southeast boundary of Section 12, 562.16 feet to a point; THENCE N 61°00'00" West 50.00 feet to a point; THENCE Northeasterly along the arc of a circular curve to the left whose central angle = 90°, radius = 10.00 feet, tangent length = 10.00 feet, a distance of 13.71 feet to a point of tangency; THENCE North 29°00'00" East, with the Southeast line of said Lot 3, Block 8, 579.97 feet to the POINT OF BEGINNING.
