AMENDING THE ZONING ORDINANCE UPON APPLICATION OF ARIEL A.
GARCIA BY GRANTING A SPECIAL COUNCIL PERMIT FOR SPECIFIED
"B-1" USES ON LOT 16 AND THE WEST 10' OF LOT 15, BLOCK 2,
KOOLSIDE ADDITION; AND DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council its
reports and recommendations concerning the application of Ariel A. Garcia, for
amendment to the zoning map of the City of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons wishing
to appear and be heard were heard, to consider the same before the City Council
of the City of Corpus Christi, in accordance with proper notice to the public,
said public hearing having been held on Tuesday, March 28, 1989, during a
meeting of the City Council in the Council Chamber at City Hall in the City of
Corpus Christi; and
WHEREAS, by motion duly made, seconded and carried, it was decided by
the City Council that to approve the hereinafter set forth amendment would best
serve public health, necessity and convenience and the general welfare of the
City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus Christi,
Texas, is amended by making the change hereinafter set out.
SECTION 2. That a Special Council Permit be granted on Lot 16 and the
West 10' of Lot 15, Block 2, Kool s i de Addition, situated in the City of Corpus
Christi, Nueces County, Texas, and further described by metes and bounds
attached as Exhibit A, for specified "B-1" uses, in accordance with the site
plan, a copy of which is attached hereto and made a part hereof, marked
Exhibit 13, and the following conditions, and subject to all other considerations
of "AB" Professional Office District:
1. That permitted "B-1" uses be limited to automobile oil change and
brake and muffler replacement and repair (all other automobile
service or body work excluded) .
2. That operation be limited to Monday through Saturday from 7 a.m.
to 9 p.m.
3. That no exterior storage or work be permitted on the premise.
4. That an 8' standard screening fence be constructed along the rear
property line and a 6' standard screening fence be constructed
along the side property lines extending at least 10' toward the
street from the front of the building.
5. That wall signage be limited to 20 square feet in area and that
one free standing sign, 20 square feet in area and 15 feet in
height, be permitted.

6. That one curb cut be permitted.
7. That development of the property conform with all other
applicable City requirements (i.e. landscaping, parking,
setbacks).
In the event the Board of Adjustment grants any special exception or
variance to the Zoning Ordinance, applicable to the Special Permit herein
granted, other than the one specified in this Special Permit, said Special
Permit shall be void and of no force and effect whatsoever.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of Corpus
Christi, Texas, approved on the 27th day of August, 1937, as amended from time
to time, except as herein changed, shall remain in full force and effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That upon written request of the Mayor or five Council
members, copy attached, to find and declare an emergency due to the need for
efficient administration of City affairs by granting the aforesaid zoning
change, such finding of an emergency is made and declared requiring
suspension of the Charter rule as to consideration and voting upon ordinances
at three regular meetings so that this ordinance is passed and sha take effect

A 0.2571 acre tract, more or less, being Lot 16 and the West 10 feet of Lot 15,
Block 2, Koolside Addition, as shown on Plat of Record in Volume 13, Page 33,
Nueces County Map Records, Nueces County, Texas and more particularly described
by metes and bounds as follows;
BEGINNING at a point on the North R.O.W. line of existing 60 foot wide McArdle
Road, the southwest corner of said Lot 16 for the southwest corner of this
tract;
THENCE in a northeasterly direction with the West line of said Lot 11, 140.00
feet, more or less, to a point, the northwest corner of said Lot 16 for the
northwest corner of this tract;
THENCE in a southeasterly direction, with the north line of said Lot 16, at
70.00 feet, more or less, pass its northeast corner, a distance in all of 80.00
feet, more or less, to a point on the north line of aforementioned Lot 15, for
the northeast corner of this tract;
THENCE in a southwesterly direction with a line 10.00 feet east of and parallel
to the East line of said Lot 16, a distance of 140.00 feet, more or less, to a
point on the North line of aforementioned 60.00 foot wide McArdle Road, for the
southeast corner of this tract;
THENCE in a northwesterly direction with said North R.O.W. line of 60.00 foot
wide McArdle Road, at 10.00 feet, more or less, pass the southeast corner of
aforementioned Lot 16, a distance in all of 80.00 feet, more or less, to the
POINT OF BEGINNING.

For the reasons set forth in the emergency clause of the foregoing ordinance
or resolution, an emergency exists requiring suspension of the Charter rule
as to consideration and voting upon ordinances or resolutions at three
regular meetings; I/we, therefore, request that you suspend said Charter rule
and pass this ordinance or resolution finally on the date it is introduced,
or at the present meeting of the City Council.
