AMENDING THE CITY CODE, CHAPTER 38, PEDDLERS, VENDORS,
ITINERANT MERCHANTS AND SOLICITORS, SECTION 38-13, PERMITS -
DENIAL OR REVOCATION, TO INCLUDE VIOLATION OF ANY STATE
STATUTE OR FEDERAL LAW OR THE APPLICANT HAVING TWO OR MORE
PERMITS REVOKED IN THE PRECEDING CALENDAR YEAR BECAUSE OF
FRAUD OR MISREPRESENTATION AS GROUNDS FOR DENIAL OR
REVOCATION OF A CITY PERMIT; PROVIDING FOR SEVERANCE; AND
PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code, Chapter 38, Peddlers, vendors,
itinerant merchants and solicitors, Section 38-13, Permits - denial or
revocation, is hereby amended by adding new subparagraphs (a) (4) and (5) to
read as follows:
Section 38-13. Same - Denial or revocation.
(a) Any permit may be denied or revoked for any of the following
causes:
(4) Activities or conduct in violation of any state statutes or
federal law governing the transaction or product of the
business required to be permitted by this article.
(5) Two or more permits held by the applicant having been
revoked in the preceding calendar year prior to the
application for a permit because of fraud or
misrepresentation in a previous application or from fraud or
misrepresentation made in the course of carrying on the
permitted business.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
SECTION 3. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
