AUTHORIZING THE EXECUTION OF AN AGREEMENT
WITH THE STATE DEPARTMENT OF HIGHWAYS AND
PUBLIC TRANSPORTATION FOR THE CITY'S
PARTICIPATION IN THE CONSTRUCTION OF A
ROADWAY ILLUMINATION SYSTEM FROM THE SOUTH
END OF THE NUECES BAY CAUSEWAY TO BURLESON
STREET ON U.S. HIGHWAY 181.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby
authorized to execute an areement with the State Department of
Highways and Public Transportation all as more fully set forth in
the agreement, a substantial copy of which is attached hereto and
made a part hereof, marked Exhibit "A."

day of , 1989, by and between
the City of Corpus Christi, Texas, hereinafter called the "City", Party of the
First Part, acting by and through its City Manager and the State of Texas,
hereinafter called the "State", Party of the Second Part, acting by and through
its State Highway and Public Transportation Commission.
WHEREAS, it is the desire of the State and City to construct a road
illumination system within the limits from south end of Nueces Bay Causway to
Burleson Street on U. S. Highway No. 181. The State will perform or have
performed this work and the City will pay fifty per cent (50%) of the cost of
this work estimated to be One Hundred Eighty Five Thousand Two Hundred Fifty
Tnree and 86/100 Dollars ($185,253.86), excluding preliminary engineering. It
is estimated the City's share is Ninety Two Thousand Six Hundred Twenty Six and
93/100 Dollars ($92,626.93), including contingencies and construction
engineering.
NOW THEREFORE, it is understood that the State will perform or have
performed this proposed work. The total estimated cost of this work amounts to
One Hundred Eighty Five Thousand Two Hundred Fifty Three and 86/100 Dollars
($185,253.86). The City will pay fifty per cent (50%) of the cost of this work
and it is estimated the City's share is Ninety Two Thousand Six Hundred Twenty
Six and 93/100 Dollars ($92,626.93), and the City will transmit to the State
with the return of this agreement, executed by the City, a warrant or check made
payable to the State Department of Highways and Public Transportation in the

amount of Ninety Two Thousand Six Hundred Twenty Six and 93/100 Dollars
($92,626.93), to be used in paying for the City's share of the proposed work.
It at any time it is found that this amount is insufficient to pay the City's
portion, then the City upon request of the State will forthwith supplement this
amount by an amount equal to the City's full estimated or actual share of the
cost of this work less the amount previously paid to the State Department of
Highways and Public Transportation. In the event the amount as paid is more
than the actual cost of the City's share, as -herein established, then the excess
amount will be returned to the City.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to be
executed in duplicate on the day above stated.
