HomeMy WebLinkAbout020715 ORD - 07/18/1989AN ORDINANCE CLOSING AND ABANDONING A 5 FOOT WIDE UTILITY EASEMENT IN LOTS 1, 2, AND 5, BLOCK 38, KING'S CROSSING UNIT I, PHASE I, AND LOT 27, BLOCK 24, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND A 7.5 FOOT WIDE UTILITY EASEMENT IN LOT 1, BLOCK 28, AND LOT 1, BLOCK 39, KING'S CROSSING UNIT 1; SUBJECT TO THE PROVISIONS LISTED BELOW. WHEREAS, there exists a 5 foot wide utility easement in Lots 1, 2, and 5, Block 38, King's Crossing Unit I, Phase I, shown by plat in Volume 51, Pages 53-65, and Lot 27, Block 24, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map Records, Nueces County, Texas; and a 7.5 foot wide utility easement in Lot 1, Block 28, and Lot 1, Block 39, King's Crossing Unit 1, shown by plat in Volume 51, Pages 53-65, Map Records, Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easements, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 5 foot wide utility easement in Lots 1, 2, and 5, Block 38, King's Crossing Unit 1, Phase I, shown by plat in Volume 51, Pages 53-65, and Lot 27, Block 24, Flour Bluff and Encinal Farm and Garden Tracts, shown by plat in Volume A, Pages 41-43, Map Records, Nueces County, Texas; and a 7.5 foot wide utility easement in Lot 1, Block 28, and Lot 1, Block 39, King's Crossing Unit 1, shown by plat in Volume 51, Pages 53-65, Map Records, Nueces County, Texas, subject to the property being replatted at applicant's expense within 180 days of passage of this ordinance. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 208HG003.ord ?'1 7 15 MICRDFIL ED That the foregoing ordinance was read for ,the first time and19 i>` passed to its second reading on this the ,'y day of / , by the following vote: Betty N.
