AMENDING THE CITY CODE, CHAPTER 13, BUILDINGS; CONSTRUCTION
AND RELATED OPERATIONS; HOUSING AND HOUSING PREMISES
STANDARDS, ARTICLE VII, MECHANICAL CODE, SECTION 13-221,
ADOPTED; AMENDMENTS, BY AMENDING SUBSECTIONS 103.5(b), 104.2
(a) AND (b), 106.3, AND 106.4 ; PROVIDING FOR SEVERANCE;
PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Code, Chapter 13, Buildings; Construction
and Related Operations; Housing and Housing Premises Standards, Article VII,
Mechanical Code, Section 13-221, Adopted; Amendments, is hereby amended by
amending Subsection 103.5, Requirements Not Covered by Code, by adding a new
subparagraph (b) to read as follows:
103.5(b) --General Inspections.
The Chief Plumbing/Mechanical Inspector may initiate
re -inspections of existing mechanical installations, devices and
equipment or that may hereafter be installed and within the scope of
this code. When the installation, equipment, or fixture is found to
be defective, dangerous or in an unsafe condition, or there is found
to be insufficient required facilities or facilities inaccessible to
the customers, then the person, firm or corporation owning, using or
operating the same shall be notified in writing and shall make the
necessary repairs or corrections required to comply within five (5)
days or a longer period specified by the Chief Plumbing/Mechanical
Inspector in said notice. If corrections are not completed within the
specified time, the Chief Plumbing/Mechanical Inspector may proceed
with further legal action to obtain compliance or shall immediately
order the discontinuance of utilities to the premises until same has
been remedied as directed.
SECTION 2. That the City Code, Chapter 13, Buildings; Construction
and Related Operations; Housing and Housing Premises Standards, Article VII,
Mechanical Code, is hereby amended by amending Section 13-221, Ado ted;
amendments, Subsection 104.2, Permits Not Required by amending paragrap s a
ani (b) to read as follows:
104.2 --Permits Not Required
(a) Ordinary minor repairs may be made without a permit, as outlined
in paragraph 104.2(b). The making of such ordinary minor repairs
without a permit shall be in compliance with the code's technical
requirements and shall not be deemed authority to violate the
City's Code.

(b) Permits shall not be required for the following:
1. Any electrical portable heating appliance;
2. Any portable ventilation equipment;
3. Any portable cooling unit;
4. Any steam, hot or chilled water piping within any heating or
cooling equipment regulated by this code;
5. Replacement of any individual component part or composite
component part within an approved assembly unit, in which
its replacement and replacement part do not alter its
original approval or make it unsafe and complies with this
code. This exception shall not be construed to include
replacement of a complete assembly unit such as a condensing
unit, furnace, or other such assembly units as assembled by
the original equipment manufacturer;
6. Any portable evaporative cooler;
7. Any self-contained refrigeration system containing ten (10)
pounds or less of refrigerant and actuated by motors of one
(1) horsepower or less;
8. Replacing or repairing of existing vent pipes with proper
clearances and roof flashing;
SECTION 3. That the City Code, Chapter 13, Buildings; Construction
and Related Operations; Housing and Housing Premises Standards, Article VII,
Mechanical Code, Section 13-221, Adopted; Amendments, is hereby amended by
amending Subsections 106.3, Failure to •btain a Permit, and 106.4, Investigation
Fee, to read as follows:
106.3 --Failure to Obtain a Permit.
(a) In the event that work for which a permit is required by
this Code is commenced prior to the issuance of the required
permit, then a fee shall be due in accordance with the
Permit Fee Schedule.
106.4 --Investigation Fee
In the event that an inspection is made and the resultant
discovery is that work for which a permit is required by this code,
has been done, but the required permit has not been issued or
obtained, then an investigation fee shall be due in accordance
with the Permit Fee Schedule.
SECTION 4. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, subdivision, clause, phrase, word
or provision of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.

SECTION 5. Publication shall be made one time in the official
publication of the City of Corpus Christi by publishing the caption stating in
substance the purpose of the ordinance, this ordinance to become effective upon
such publication.
