AMENDING ORDINANCE 13168, AS PREVIOUSLY
AMENDED, WHICH ESTABLISHED THE CORPUS CHRISTI
RETIREMENT PLAN, PROVIDING FOR TERMINATION
OF THE PLAN; PROVIDING FOR DISTRIBUTION OF
ALL CONTRIBUTIONS AND INTEREST UPON
TERMINATION OF THE PLAN; PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1: That Ordinance 13168, as previously amended,
be amended by deleting Sections 11 and 12 and adding the
following new Section 11:
Section 11. Notwithstanding any of the above
provisions, the Corpus Christi Retirement Plan ("CCRP"
or the "Plan") shall terminate on July 31, 1989. Upon
termination of the CCRP, all amounts then held in such
fund shall be held and disbursed as follows:
(A) All CCRP funds attributable to participant
contributions together with all interest attributable
thereto shall be paid to the participant effective as
of the date of termination of the Plan.
(B) Upon termination of the CCRP, all CCRP funds
attributable to City contributions and all interest
attributable thereto shall be transferred to the
General Fund.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word or
provision of this ordinance, for it is the definite intent of
this City Council that every section, paragraph, subdivision,
clause, phrase, work or provision hereof be given full force and
effect for its purposes.
