HomeMy WebLinkAbout020735 ORD - 07/25/1989AN ORDINANCE AMENDING THE CITY CODE, CHAPTER 21, GARBAGE, TRASH AND OTHER REFUSE, BY DELETING SECTIONS 21-19 (b), 21-20, AND 21-21.1, AND SUBSTITUTING THEREFOR A NEW SECTION 21-19(b); AMENDING SECTIONS 21-17, 21-18, 21-19(a) AND 21-21; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Code, Chapter 2i, Garbage, Trash and other Refuse, is amended by amending 21-17, Disposal Services - Available. to read as follows: Section 21-1; Dispcsai .erv: f,-ct,able (a) The disposal services of the sanitation division are deemeo available to every premise occupied for residential use within the City of Corpus Christi, and the owner, occupant, tenant, or lessee shall pay the charges therefor. If the owner or occupant of a premises has made arrangements for disposal of garbage and trash by a private garbage collection service in accordance with all applicable laws and regulations, the Director of Solid Waste Services may waive disposal charges for such premises. The Director of Solid Waste S(:rvi_es may waive such disposal charges only upon presentation of an .,ffir,:e. i; the cwrcr, occupant, or private collection service indicating the address of the premises being served as provided by Section 21-4. Upon the expiration of the exemption as provided by Section 21-4, all prernises exempted shall pay disposal charges upon commencement of City collection services to the prernises. (b) For premises used as commercial or business establishments a disposal fee shall be charged for each premise being served by collection services of the City sanitation division. SECTION 2. That the City Code, Chapter 21, Garbage, Trash and Other Refuse, is amended by amending Settler Li -1S to read as follows: Sec. 21-18. Charges --For services to residences. All residences, apartments, and other premises nut serviced by the Department or `,a1 is ''_ _ oruices will rot be charged a disposal fee except as provided by Section 21-19(b). SECTION 3. That the City Code, Chapter 21, Garbage, Trash and Other Refuse, is amended by deleting Sections 21-19 (b), 21-20, and 21-21.1, and substituting therefor a new Section 21-19 (b) and amending Section 21-19(a) to read as follows: Section 21-19. Same --To business and commercial establishments, etc. (a) The business and commercial institutions and all other occupied premises in the City of Corpus Christi for which the collection service of the sanitation division is requested, except residences ccverc.: :T'y section 21-18 of this code, shall be charged at a minimum rate of fifteen dollars and thirty-two cents ($15.32) for two (2) days per week pickup. All charges above the minimum rates shall be determined by the the Director of Solid Waste Services; shall be reasonable; shall be determined by the type and amount of refuse, the location of the refuse and the number of pickups per week that are necessary to properly service and maintain sanitary conditions; and shall be not less than an amount proportional to the minimum charges provided in this article, said minimum charges being based on collection of cue cubic: yarc of garbage per week. 208RP074.ord (b) Persons disposing of Solid Waste and Rubbish, at any City Disposal Site designated by the Director of Solid Waste Services shall pay a Disposal Fee for each and every load of Solid Waste deposited in accordance with the schedule below. The composition of all loads as it applies to the appropriate fee to be paid shall be determined by the Director of Solid Waste Services or his designee. Unless contractual arrangements specify otherwise, the Director of Solid Waste Services may authorize special agreements for disposal of Solid U,a�r_r Lith other agencies. Passenger cars, station wagons, pickups and single axle trailers used by Corpus Christi residents to haul owner's waste (with valid Driver's License showing current Corpus Christi address) except for special fees for appliances and tires. In the event new fees are imposed by the state for disposal of Solid Waste and are required to be collected by the City, such fees will be added to and become a part of the appropriate fee charged tc the Landfill user. SECTION 4. Section 21-21 Same - For Large Animal is amended to read :0Hows: :rctiui, r--21. Disposal Fee For Large Dead Animals. A direct charge not to exceed $200.00 per animal as established by the Director of Solid Waste Services for removal and disposal of dead animals shall be charged at the time of removal. SECTION 5. Any provisions of Chapter 21, referring to Sanitation Superintendent shall now be referred to as the Director of Solid Waste Services. Section 21-1 Definitions is amended to delete the definition of superintendent and insert the following definition: Director of Solid Waste Services: the Director of Solid Waste Services of the City of Corpus Christi. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 7.
