CLOSING AND ABANDONING TRAVIS AVENUE FROM SCHANEN BOULEVARD
TO DUBLIN DRIVE ADJACENT TO LOTS 8 AND 9, SCHANEN ESTATES
UNIT 1, SHOWN BY PLAT IN VOLUME 20, PAGE 17, MAP RECORDS,
NUECES COUNTY, TEXAS, AND ADJACENT TO LOTS 23 AND 24,
SCHANEN ESTATES UNIT 3, SHOWN BY PLAT IN VOLUME 24, PAGE 12,
MAP RECORDS, NUECES COUNTY, TEXAS, SUBJECT TO THE PROVISIONS
LISTED BELOW.
WHEREAS, Travis Avenue runs from Schanen Boulevard to Dublin
Drive adjacent to Lots 8 and 9, Schanen Estates Unit 1, shown by plat
in Volume 20, Page 17, Map Records, Nueces County, Texas, and adjacent
to Lots 23 and 24, Schanen Estates Unit 3, shown by plat in Volume 24,
Page 12, Map Records, Nueces County, Texas.
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said street
right of way, subject to the provisions listed below:
Relocating any utility lines located within
the street right of way.
Subject to payment of fair market value in
the amount and under terms and conditions
established by the City Council.
Replatting the property within 180 days.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI:
SECTION 1. That Travis Avenue from Schanen Boulevard to
Dublin Drive adjacent to Lots 8 and 9, Schanen Estates Unit 1, shown
by plat in Volume 20, Page 17, Map Records, Nueces County, Texas, and
adjacent to Lots 23 and 24, Schanen Estates Unit 3, shown by plat in
Volume 24, Page 12, Map Records, Nueces County, Texas, be and the same
is hereby closed for public use and every municipal purpose, subject
to relocating any utility lines located within the street right of way
and replatting of the property within 180 days.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance shall
be held invalid or unconstitutional by final judgment of a court of
competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this
ordinance, for it is the definite intent of this City Council that
every section, paragraph, subdivision, clause, phrase, word or
provision hereof be given full force and effect for its purpose.
